1 <br />ishe hereby reaffirms the written agreement bearing date August S, 1924, made between herself and <br />her husband, Isaac A.McCarty, relating to his last will and testament of that date and attached <br />thereto. <br />Dated February 13, 1928. <br />WITNESS: <br />Ezra N.Currier <br />Laura A.Currier <br />(ENDORSED) No. 142510 <br />Ona B.McCarty <br />449 <br />First codicil to last will <br />and testament of Isaac A.McCarty. <br />A G R E E M E N T <br />between <br />ISAAC A.McCARTY <br />AND <br />ONA B.McCARTY <br />IT IS AGREED between ISAAC A.McCARTY and ONA B. McCARTY, husband and wife, as follows: <br />WHEREAS, the will of each party hereto and codicils thereto provide for or relate to certain <br />charitable bequests and devises intended by each party heret6 to be effective as to the property <br />over which they have testamentary control and disposition. Certain provisions of the Civil Code <br />of the State of California limit or restrict the right of the husband to dispose of community <br />property by will and Section 1313 of said Civil Code limits and restricts the right of a testator <br />to dispose of his property by will for charitable uses or purposes. Each party hereto has made <br />ja will dated August 8, 1924, and codicils thereto. Each one is wholly familiar with the provisior. <br />of the will of the other and hereby assents to all thereof and expressly waives the restriction of <br />said Section 1313 of the Civil Code; it being the purpose and intention of the parties hereto that <br />their respective wills shall be given full effect according to the purport thereof regardless of <br />limitations or restrictions of statutes of any state wherein the property is situated affecting <br />the power of a testator to dispose of his property to charitable institutions or for charitable <br />uses or purposes. <br />IN WITNESS WHEREOF, we have hereunto set our hands, in duplicate, the 31 day of March, 1931. <br />Ezra N.Currier <br />Laura A.Currier <br />- - - - - ( ENDORSED) No. 1+2510 <br />Dated: March 1931. <br />ISAAC A.McOARTY AND ONA B:.,dcCARTY <br />AGREEMENT. <br />�� - <br />SECOND CODICIL <br />to <br />LAST WILL AND TESTAMENT <br />of <br />ISAAC A. McCARTY <br />Isaac A.McCarty <br />Ona B.McCarty <br />I, ISAAC A.McCARTY, do hereby make this the second codicil to my last will and testament which <br />bears date August S, 1924, as follows: <br />The Security Trust and Savings Bank, a corporation of Los Angeles, is by the provisions of my <br />said will appointed joint trustee with my wife, Ona B.McCarty, to administer certain trusts create <br />by said will; And it is also provided in my said will that if my said wife should fail to qualify <br />as executrix, or should fail to complete the administration of my estate, said bank shall act as <br />executor of my said will. Since the date of my said will said bank has merged with another bank <br />the consolidated institution being known as "Security -First National Bank of Los Angeles.* I herei <br />direct that said Security -First National Bank of Los Angeles act as trustee in place of said <br />Security Trust and Savings Bank and in the contingency mentioned in my said will as executor ther( <br />of. <br />
