<br />Now on this 7 day of May, 1936, this cause came on for further hearing, the Final Report of the
<br />Administrator with the will annexed, after due and proper notice had been given to all interested
<br />parties, having been approved by order of this Court on the 29th day of April, 1936.
<br />This cause coming on further to be heard, the Court finds that due notice has been given to all
<br />creditors of said estate in the manner provided by law of the date fixed for presenting claims
<br />against the estate of said deceased; that the time allowed for filing claims has entirely expired;
<br />that all claims filed and allowed against said estate have either been paid or the funds are being
<br />made available for the payment thereof; that the funeral expenses of said deceased, and the costs
<br />of administering said estate have been allowed and are to be paid from the proceeds of a partition
<br />action, that when receipts therefor are filed in this Court there will be sufficient evidence of
<br />the payment thereof. That all other claims not filed, if any such there be, are forever barred
<br />and excluded.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that all persons are forever barred
<br />from filing or setting up any claims or demands against the estate of the said Joan Sims, and that
<br />when receipts have been filed for claims that are unpaid and have been allowed that said estate
<br />will be then fully settled and closed.
<br />The Court finds that the Administrator with the will annexed has received in cash from all sources
<br />the sum of $1976.49, and that he has expended in the administration of said estate the sum of
<br />$1845.29.
<br />That the cash on hand as shown by said report, to -wit:: the sum of $31.20 is to be used in connecti
<br />with money received from the Referee in the partition suit wherein certain real estate belonging
<br />to said estate was partitioned, in the payment of bills allowed against said estate which are yet
<br />unpaid.
<br />That the only remaining asset belonging to said estate is a $1000.00 Participating Certificate
<br />itemized in the inventory as Certificate No. 2035 in the sum of $1000.00 on Loan No. 809 -34
<br />(Grand Island Trust Company number), said mortgage being in the principal sum of $6000.00, Mde
<br />to Bodie- Reynolds on land located in Weld County, Colorado.
<br />The Court finds that a sufficient offer has not_been made for the purchase of said Certificate;
<br />that in order to close said estate said certificate should be divided into several parts, one -
<br />fourth thereof to be delivered to the Executor or Administrator, as the case may be, of the Last
<br />Will and Testament of Anna F.Sims, the widow, who is now deceased, and the remaining parts should
<br />be delivered to the beneficiaries as by the Last Will and Testament of said deceased provided,, To
<br />that end it is ordered that the Administrator with the will annexed assign said certificate to
<br />himself, as Trustee for the use and benefit of interested parties, and that he is authorized,
<br />empowered and directed to make the proper division of said certificate among those bntitled theret
<br />The Court finds that the estate is not subject to Federal Estate or State Inheritance taxes.
<br />The Court finds that said John Sims departed this life at his home in Hall
<br />November 20, 1934, leaving a Last Will and Testament which was admitted to
<br />21, 1934•
