<br />Now on this 7th day of March, 1935, this cause came on for hearing upon the petition of Jonas Guy,

<br />praying for the settlement of said estate, for a determination of the heirship and right-of des -
<br />cent of the real estate belonging to Joseph Guy, and the degree of kinship of his heirs at law,
<br />and a decree settling his estate.
<br />AND IT APPEARING to the court from the proofs on file herein that due and legal notice has been
<br />given by publication for three successive weeks, as by law and the order of this court provided,
<br />to all creditors, heirs at law, and other persons interested in said estate, of the filing of said
<br />petition and of the time and place fixed for the hearing of the same., and there being no objectio s
<br />thereto, this cause was duly submitted to the court, upon the petition and the evidence in support
<br />thereof, and the court being duly advised in the premises finds that the allegations in said pets -
<br />tion are true, and that said petitioner, Jonas Guy, is the present owner of an undivided one -sixt
<br />l interest of the real estate hereinafter described and is a competent and proper person to prosecute
<br />this proceeding; that the said Joseph Guy died intestate in Hall County, Nebraska, on the 7th day
<br />of February, 1927, and at the time of his death, the said Joseph Guy was a resident and inhabitant
<br />of Hall County, Nebraska, and died seized as the owner in fee simple title of the North half of
<br />the Northeast quarter (N2 NEJ) of Section Twelve (12) in Township Eleven (11) North, of Range
<br />Twelve (12) West of the 6th P.M. in Hall County, Nebraska, containing 90 acres, a little more or
<br />less, and that more than eight years have elapsed since his death,.and that no application has
<br />ever been made in the state of Nebraska for the appointment of administrator of his estate, and
<br />no petition filed for that purpose, and no administration has ever been had upon the estate of
<br />Joseph Guy, deceased.
<br />The court further finds that the said Joseph Guy left surviving him as his heirs at law and only
<br />heirs at law, the following named persons, to -wit:
<br />Eliza J.Guy, widow,
<br />Willis Guy, a son,
<br />Jonas Guy, a son,
<br />Charles Guy, a son,
<br />Acy Guy, a son,
<br />Elry Guy, a son,
<br />Nancy E.Guy, a daughter,
<br />all of whom are of legal age.
<br />The court further finds that under the laws of the state of Nebraska in force at the time of the
<br />death of the said Joseph Guy, the real estate hereinbefore described, passed and descended in
