1 <br />1 <br />1 <br />u <br />369 <br />land was commonly known as Emil Detlefsen and that said adopted daughter on her marriage went by <br />the name and was commonly known as Helen Detlefsen Preston; that said adoption was duly made by <br />the intestate and her husband -under the laws of the State of Iowa as they existed in 190+ and duly <br />recorded on December 21, 1904, in Book 41 of the Miscellaneous Records of Woodbury County in the <br />State of Iowa at page 339, and that a certified copy of the same was produced at the hearing here- <br />of; that all of said real estate above described and any other real estate owned by the deceased <br />at his death under the last will and testament of the deceased, passed and descended under the <br />statutes of the State of Nebraska to Helen Detlefsen Preston, his adopted daughter, in fee simple. <br />The court further finds that the deceased died seized of sundry articles of wearing apparel, house• <br />hold articles and ornaments of the person of inconsequential value, which passed to said adopted <br />daughter under said will. The court further finds that the personal property of the deceased has <br />been delivered to said adopted daughter pursuant to the said will; that the deceased also died <br />possessed of a half interest in one certificate for twenty -five sharesof the capital stock of the <br />Jayhawk Producing and Refining Company, dated August 5, 1930, numbered 15, and the entire-interest <br />in a like certificate for twenty -five shares of said stock certificate No. 15; that the same passe, <br />and descended to Helen Detlefsen Preston; that Emil C.Detlefsen died leaving Helen Detlefsen Preston <br />as his sole and only devisee and legatee and the court finds that said certificates have been duly <br />assigned and transferred to Helen Detlefsen Preston by her as executrix of the estate of Emil C. <br />Detlefsen. The court further finds that the estate has been fully administered, that all expenses <br />of administration have been fully paid by Helen Detlefsen Preston, and that the estate should be <br />closed and the executrix discharged of her trust and her 'fond released. <br />IT IS TIEREFORE CONSIDERED, ADJUDGED AND DECREED BY THE COURT: <br />That the final account and report of Helen Detlefsen Preston as executrix of said estate ba and it <br />is hereby approved and allowed; that all claims filed or allowed against said estate have been ful <br />ly paid; that all expenses and costs of the administration of said estate have been fully paid; <br />that the succession to said estate is not subject to any inheritance tax under the laws of the <br />State of Nebraska or any Federal Estate Tax; that all claims and debts not filed against said esta <br />if any,are forever barred and precluded; that the deceased left as his sole and only heir, devisee <br />and legatee, his adopted daughter, Helen Detlefsen Preston; that the deceased died seized in fee <br />simple of an undivided half interest as tenant in common with Helen Detlefsen Preston in and to <br />Lots One Hundred Fifty -nine and One Hundred Sixty in Belmont Addition to the City of Grand Island <br />in Hall County, Nebraska and all of Lot Seven (7) in Block Twenty -seven (27) in the original town <br />now City of Grand Island in Hall County, Nebraska and West Half (W a) of Lot One Hundred Sixty Nine <br />(169) in Section F of the Grand Island Cemetery in said city of Grand Island and -that -all said <br />real estate and any other real estate belonging to the deceased at his death passed and descended <br />in fee simple under the last will and testament of the deceased and under the statute of wills of <br />Nebraska to Helen Detlefsen Preston, his adopted daughter and his devisee and legatee, and the sari <br />is so awarded to her; that the personal estate of the deceased has been disbursed and distributedlll <br />pursuant to the orders of the court; that the estate has been fully administered and is hereby <br />settled and closed and the bond of the executrix released and the executrix is discharged of her <br />trust.
