<br />.1I, Paul N.Kirk, Judge of the County Court in and for said County, do hereby certify that on the
<br />17th day of March, 19320 the instrument purporting to be the last will and testament of Emil C
<br />Detlefsen, deceased, was filed for probate in this Court. That on the 12th day of April 1932,
<br />instrument to which this certificate is attached was duly proved, probated and allowed as the
<br />will and testament of the real and personal estate of said Emil C.Detlefsen, aeceasea, and the
<br />was ordered to be recorded in the records of the Court aforesaid.

<br />!Now on this 4th day of October, 1932, this cause came on to be heard by the court upon the final
<br />;account and report of Helen Detlefsen Preston, executrix of said estate, and it appearing from the
<br />!evidence and proofs on file in this court that legal notice as by law and the order of the court
<br />{
<br />,required, has been given to all persons interested, of the time and place of examining and allow-
<br />ling said final account, by publication for three' successive weeks in a legal newspaper published
<br />!within said Hall County, and there being no objections to said final account and report, the court
<br />,on examination thereof, finds that the same is in all respects correct and should be allowed and
<br />approved.
<br />!The eburt further finds from the proofs on file herein, that legal notice as by law and the order
<br />t
<br />pof this court required, has been given to all persons having claims against said estate of the tin
<br />'and place for filing same; that all claims filed against said estate have been fully paid and that
<br />Sall persons having unfiled claims against said estate, if any there be, are forever barred and pre
<br />lcluded from'making claim thereon, and all such unfiled claims and debts, if any, are barred and
<br />precluded; that all costs and expenses of administration have been paid; that said estate and the
<br />Isuccession thereto are not subject to any inheritance tax under the laws of Nebraska or to any
<br />federal estate tax.
<br />'The court further finds that the deceased died March 11, 1932, a resident of said Hall County,
<br />!seized in fee simple of an undivided one -half interest as tenant in common with Helen Detlefsen
<br />,Preston in and to Lots One Hundred Fifty -nine (159) and One Hundred Sixty (160) in Belmont Additic
<br />'to the City of Grand Island in Hall County, Nebraska, and that ;,ot Seven (7) in Block Twenty - sever.

<br />3(27) in the original town, now City of Grand Island in Hall County, Nebraska, was conveyed by war -

<br />ranty deed to Emil C.Detlefsen and Francies C.Detlefsen, his wife, the clause reciting payment of
<br />F
<br />!the consideration in said deed, stating that it was paid by them "with right of survivorship,"
<br />!while the granting clause and the habendum clause in said deed recited that it was granted to then

<br />!without specifying whether it was as joint tenants with right of survivorship or as tenants in con
<br />mon; that said Lot Seven (7) was the home and homestead of Emil C.Detlefsen and his wife, and the
<br />court finds from the evidence adduced that it was their intention to take title to said Lot Seven

<br />(7) as joint tenants with right of survivorship and that the interest of Francies Detlefsen in sa d
<br />lot vested in Emil C.Detlefsen in fee simple on her death by right of survivorship; that he also
<br />died seized in fee simple of the West Half (Wi) of Lot One Hundred Sixty -nine (169), Section F. i
<br />the cemetery of said city of Grand Island.
<br />The court further finds that the deceased died testate and a resident of said Hall County, leavin
<br />him surviving as his sole and only heir at law and next of kin, devisees and legatees, on March 1 ,
<br />1932, his adopted daughter, Helen Detlefsen Preston; that said daughter, Helen Detlefsen Preston
<br />was duly and legally adopted by Emil Detlefsen and Francies Detlefsen, his wife, who predeceased
<br />him, under the name of Hellen Marie; that Emil C.Detlefsen also went by the name of Emil Detlefse
