L <br />iJ <br />1 <br />IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the County Court at <br />Hastings, this 9th day of January, 1936. <br />W.Halsey Bohlke <br />(SEAL) County Judge. <br />Filed for record this 16th day of January, 1936, at 4 :00 o'clock R.M. <br />egister of Deeder <br />0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- u- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0- 0 -0 -0- <br />FINAL DECREE. <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />In the Matter of the Estate of ) <br />) FINAL DECREE. <br />Francies Detlefsen, deceased. ) <br />Now on this 4th day of October, 1932, this cause came on to be heard by the court upon the final <br />account and report of Helen Detlefsen Preston, administratrox of said estate, and it appearing f. <br />the evidence and proofs on file in this court that legal notice as by law and the order of the <br />court required, has been given to all persons interested, of the time and place of examining and <br />allowing said final account, by publication for three successive weeks in a legal newspaper pub- <br />lished within said Hall County and there being no objections to said final account and report, <br />the court, on examination thereof, finds that the same is in all respects correct and should be <br />allowed and approved. <br />The court further finds from the proofs on file herein, that legal notice, as by law and the order <br />of this court required, has been given to all persons having claims against said estate of the tin <br />and place for filing same; that all claims filed against said estate have been fully paid and that <br />all persons having unfiled claims against said estate, if any there be, are forever barred and pre <br />cTuded from making claim thereon, and all such unfiled claims and debts, if arty, are barred and <br />precluded; that all costs and expenses of administration have been paid; that said estate and the <br />succession thereto are not subject to any inheritance tax under the laws of Nebraska or to any <br />federal estate tax. <br />The court further finds that the deceased died seized in fee simple of Lots One Hundred Fifty -nin <br />(159) and One Hundred Sixty (160) in Belmont Addition to the City of Grand Island in Hall County, <br />Nebraska, and that Lot Semen Min Block Twenty -seven (27) in the original town, now.City of Gran <br />Island in Hall County, Nebraska, was conveyed by warranty deed to Emil C.Detlefsen and Francies C. <br />Detlefsen, his wife, the clause reciting payment of the consideration in said deed, stating that <br />it was paid by them "with right of survivorship," while the granting-clause and the habendum <br />clause in said deed recit6d that it was granted to them without specifying whether it was as join <br />tenants with right of survivorship or as tenants in common; that said Lot Seven (7) was the home <br />and homestead of Emil C.Detlefsen and his wife, and the court finds from the evidence adduced that <br />It was their intention to take title to..sdld Lot Seven (7) as joint tenants with right of survivor <br />ship and that the interest of Francies Detlefsen in said lot vested in Emil C.Detlefsen in fee si <br />on the death of the deceased by right of survivorship. <br />The court further finds that the deceased died intestate on December 28, 1931, a resident of said <br />Hall County, leaving her surviving as her sole and only heirs at law and next of kin, her husband,i <br />Emil C.Detlefsen and her adopted daughter, Helen Detlefsen-Preston; that said daughter, Helen <br />Detlefsen Preston was duly and legally adopted by Emil Detlefsen and Francies Detlefsen under the <br />name of Hellen Marie Detlefsen; that Francies C.Detlefsen also went by the name and was commonly <br />known as Francies Detlefsen and her husband, Emil C.Detlefsen also went by the name and was common <br />ly known as Emil Detlefsen and that said adopted daughter on her marriage vent by the name and was <br />commonly known as Helen Detlefsen Preston; that said adoption was duly made by the intestate and <br />her husband under the laws of the State of Iowa as they existed in 1904 and duly recorded on <br />
