<br />P.M., Hall County, Nebraska. That more than two years have elapsed since the date of the death of
<br />said John McCarl and no application for the appointment of an Administrator of his estate has bee
<br />made in the state of Nebraska by any heirs or persons claiming to be creditors of the said decede
<br />that the said John McCarl left the following persons as his sole and only heirs at law;
<br />Sarah M.McCarl, his widow, and the following children:
<br />Charles H.McCarl,
<br />Thomas E.McCarl,
<br />Bertis L.McCarl
<br />John R.McCarl,
<br />Ida M.McCarl, and
<br />Blanche McCarl
<br />The Court further finds that the petitioner is the owner of an undivided interest in said real
<br />estate as alleged in her petition.
<br />rIT IS, THEREFORE, ORDERED AND DECREED that the facts hereinbefore stated are true and the said
<br />`real estate is hereby assigned to the said heirs at law in proportions provided by law as of the
<br />:date of the death of said John McCarl.

<br />I, Henry J.Bartenbach, of Grand Island,Nebraska, being of sound mind and disposing memory, do a
<br />and publish this.,: my last will and testament, in the manner and form following, that is to say:
<br />FIRST.
<br />I direct that my just debts, if any, and the expenses attending my burial, be first paid. This
<br />has reference to my personal debts and not to debt secured by real estate mortgages.
<br />SECOND.
<br />I give and bequeath to my daughter, Helen Connell, the sum of Five Thousand (05000) Dollars, the
<br />same to be paid to her within two years after my death.
<br />THIRD.
<br />I give and bequeath.to my son, George W.Bartenbach, all of my right, title, and interest, of e
<br />kind, in and to the paint, glass, and wall -paper business, heretofore conducted by myself and my
<br />said son, under the style and firm name of "Henry J.Bartenbacb. & Son", so that my said son will
<br />be the sole owner of said business.
<br />FOURTH.
<br />I give and bequeath to my daughter, Henrietta Bartenbach, the sum of Five Thousand ($5000) D
<br />to be paid to her within two years after my death.
<br />FIFTH.
<br />I give and bequeath to each of my said children, Helen Connell, George W.Bartenbach, and Henriett
