343 <br />No® 6 HALL COUNTY <br />ENDORSED The foregoing instrument is a <br />Filed July ll- 1929 correct dopy of the original <br />Henry A.Pf inter, Clerk on file in this office <br />By C.O.Winans, Deputy ATTEST: NOV. 131 1935 <br />FRANK W.HOGAN <br />(SEAL) County Clerk and ex- officio Clerk of the <br />Superior Court of the State of California to and <br />for the County of Santa Clara <br />By T.R.Bonetti, Deputy. <br />Filed for record this 18th day of November, 1935, at 2 :00 o'clock P.M. <br />Register of Deeds <br />0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0- <br />DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />IN THE MATTER OF ) <br />THE ESTATE OF j DECREE <br />AMANDA J.NELSON, deceased ) <br />This matter coming on to be heard, there being present Herbert F.Mayer, attorney for Mary J.Baker, <br />I petitioner herein, and after an examination of the files and hearing argument of counsel, the <br />Court finds that the allegations contained in the petition of the said Mary J.Baker are true and <br />that the prayer therein should be granted, and that the order made by this Court on the first day <br />of October, 1935P Providing for publication for three successive weeks in the Grand Island Daily <br />Independent that a hearing would be had on said petition on the 31st day of October, 1935, has be <br />complied with and notice in accordance with said order, has been given herein. <br />The Court further finds specifically that Amanda J.Nelson died intestate on the 14th day of April <br />1923, a bona fides resident of said Hall County;; that no administration has been had on her estate <br />and that she is survived by Sylvester M.Nelson, her husband, and Nora Miller, Oscar E.Nelson, <br />Elmer S.Nelson, Olivine Roberts and Mary J.Baker, her heirs at law and only heirs at law, all ove <br />the age of 21 years; that she was siezed at the time of her death of an estate of inheritance in <br />an undivided one -third (1/3) interest in and to <br />4 The northerly one hundred and two and one -half (1022) feet of Lot One (1) in Block Fifty -nine (59 <br />In the Original Town, now City of Grand Island, being a rectangular piece of ground having one <br />hundred and two and one -half (1022) feet fronting on Cedar Street in said City by sixty - six =(66) <br />feet in depth off the northerly end of said lot; <br />which was not the homestead of herself or family, is now wholly exempt from attachment, execution <br />I <br />and other mesne process and not liable for the debts of said deceased; that the personal estate <br />of the deceased is not liable for her debts, if any there be. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that the said Amanda J.Nelson died intestate on the <br />14th day of April, 1923, a resident of Hall County, Nebraska, survived by Sylvester M.Nelson, her <br />husband, and Nora Miller, Oscar E.Nelson, Elmer S.Nelson, Olivine Roberts and Mary J.Baker, her <br />only heirs at law, siezed of an undivided one -third (113) interest in <br />The northerly one hundred and two and one= half.(1022) feet of Lot One (1) in Block Fifty -nine (59 <br />in the Original Town, now City of Grand Island, being a rectangular piece of ground having one <br />hundred and two and one -half (1022) feet fronting on Cedar Street in said City by sixty -six (66) <br />feet in depth off the northerly end of said lot: <br />that administration of the estate of the deceased be dispensed with and that the above named <br />persons are the heirs at law and only heirs at law and were the only persons interested in said <br />premises at the date of the death of said Amanda J.Nelson; that the said Sylvester M.Nelson is <br />the father of all of the children of the said Amanda J.Nelson and is entitled to an undivided one <br />third (1/3) interest in said undivided one -third (1/3) interest in said premises, or an undivide <br />one -ninth (1/9) interest therein, and that the said Nora Miller, Oscar E.Nelson, Elmer S.Nelson, <br />Olivine Roberts and Mary J.Baker, each are awarded an undivided two - fifteenths (2/15) interest <br />in said premises as of the date of death of said decedent, but that at this time the said Oscar <br />E.Nelson has conveyed his interest in said premises by deed duly filed and recorded. <br />The costs in the sum of $23.00 have been paid.
