<br />Now on this 23rd day of October, 19351 this cause came on for hearing before the Court upon the
<br />petition of Inez Rice for determination of heirship in the matter of the estate of the said Edith
<br />Heiman, deceased. Thereupon evidence was duly introduced and the said cause submitted to the
<br />Court. The Court finds from the evidence, and from the files and records in the said cause, that
<br />due notice of the time and place fixed for the hearing of said petition has been given by publi-
<br />cation, according to the order of the Court heretofore made and entered, finds that the said Edit]
<br />Heiman died intestate on September 16, 1933, being a resident and inhabitant of Lawrence County,
<br />South Dakota, and being seized of an interest, in fee simple, in the South Half of the Northwest
<br />Quarter (Sj NW4) and the North Half of the Southwest Quarter (N2 SWt) of Section 18, Township 9,
<br />North Range 10, West 6th P.M., Hall County, Nebraska. That more than two years have elapsed since
<br />the date of the death of the said Edith Heiman and no application for the appointment of an Admin�
<br />s
<br />istrator of her estate has been made in the state of Nebraska by her heirs or persons claiming to
<br />be creditors of the said estate. That the said Edith Heiman left surviving her the following
<br />i
<br />persons as her sole and only heirs at law, to -wit:
<br />Edward William Heiman, surviving husband, of Deadwood, South Dakota;
<br />Inez Rice, daughter, of Hall County, Nebraska;
<br />Lynn Johnson, son, of Hall County, Nebraska
<br />all being of full age.
<br />The Court further finds that the petitioner, Inez Rice, is the owner of an undivided interest in
<br />said real estate, as alleged in her petition herein, and as one of the heirs at law of the said
<br />Edith Heiman.
<br />IT IS, THEREFORE, ORDERED AND DECREED that the facts hereinbefore stated are judicially establis.
<br />as true; that the said Edith Heiman died intestate as aforesaid, being the owner df'an undivided
<br />interest in said estate; that her death took place more than two years prior to the commencement
<br />of this proceeding, and that no proceeding has been had for the administration of her estate in
<br />the state of Nebraska, and all her undivided interest in the real estate hereinbefore described
<br />is hereby assigned and set over to the said heirs at law, in equal undivided shares, to -wit:
<br />i Edward William Heiman,
<br />Inez Rice, and
<br />Lynn Johnson,
<br />as of the date of the death of the said Edith Heiman, deceased.
