<br />is hereby approved and allowed as the final report of said Executor.
<br />The Court,further finds that John D.Shearer died on November 30, 1933, in Los Angeles,County, stat
<br />of California, of which county and state he was a resident and inhabitant at the time of his death
<br />that he left a last will and testament which was, on the 11th day of January, 1934, duly proven,
<br />allowed, and admitted to probate in the Superior Court of Los Angeles County, state of California,
<br />said court having jurisdiction of the probate of wills in and for said county and state, a duly
<br />certified copy of which said last.will and testament, together with the certificate of probate
<br />thereof, has been filed herein, with the petition for probate of foreign will, on June 14, 1934;
<br />that due and legal notice was given to all Persons interested therein that a hearing would be held
<br />on the 10th day of July, 1934, for the probate of said foreign will, and codicil thereto; that on
<br />said date said instrument was duly proven, allowed, and admitted to probate in this court, as and
<br />for the last will qnd testament of said John D.Shearer, deceased, and said Harry D.Trout, named
<br />therein as executor, has qualified as such.
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for filing claims against said estate, that said time has fully expired;
<br />that all claims and expenses of administration have been paid.
<br />IT IS, THEREFORE, ORDERED that the Final report of Harry D.Trout, Executor, be, and the same is
<br />hereby allowed and approved as and for his final report and he is hereby discharged as such execu-
<br />tor and released from his bond.
<br />The Court further finds that said John D.Shearer at the time of his death was the owner of the
<br />southeast quarter of Section Four (4), in Township Ten (10) North of Range Eleven (11) West of the
<br />6th P.M., in Hall County, Nebraska, and that under the provisions of said last will and testament
<br />said premises were devised and bequeathed to Maria E.Shearer, his wife, if living at the time of
<br />his death; that said John D.Shearer died on the 30th day of November, 1933, that said Maria E.
<br />Shearer died on the 13th day of March, 1929•
<br />That under said last will and testament it is provided that in the event of the death of said

<br />Maria E.Shearer prior to the death of said testator, then said lands and premises are devised and
<br />bequeathed to Glenn Hileman, Harry Hileman, and Irene Seguine, share and share alike, provided
<br />I
<br />that said premises shall not be mortgaged or sold for a period of five years from the date said
<br />devisees receive title, and subject to the provisions that Oscar S.Hileman, a brother -in -law, of
<br />the testator, of Cheyenne, Wyoming, shall have the income of said-premises so long as said Oscar S,
<br />Hileman shall live, and that Harry D.Trout, as Trustee, of Los Angeles, California, shall collect
<br />the rents and revenues from said premises and pay the same to Oscar S.Hileman during his lifetime,
<br />and after the death of said Oscar S.Hileman, authorizes said Trustee to dispose of said premises
<br />to the aforesaid Glenn Hileman, Harry Hileman, and Irene Seguine, share and-share alike, and sub-
<br />ject to the provisions that they shall not sell or mortgage the same for a period of five years
<br />after they have taken title to same.
<br />The Court further finds that there was no inheritance tax.
<br />IT IS, THEREFC-?RE, ORDERED, that all claims against said estate, not filed herein, are forever
<br />barred and excluded.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the real estate to -wit: the southeast quarter of
<br />Section 4, Township 10 North, Range 11 West of the 6th P.M., in Hall County, Nebraska, passed and
<br />descended as brovided in said last will and testament, and as hereinbefore set forth.
