<br />FINAL DECREE.
<br />Now on this 25th day of June, 1935, this cause came on for hearing upon the final report of Mary
<br />Horst, executrix of the last will and testament of Fritz Horst, deceased, and it appearing to the
<br />satisfaction of the court from the proof now on file, that due notice as required by law, has bees
<br />given to all persons interested, of the filing of said report, and of the time fixed for final
<br />settlement of the estate of said deceased.
<br />After a full examination of said report, the court, being fully advised in the premises, finds
<br />the same is correct in all respects and ought to be allowed; that said executrix has accounted fo
<br />all of the estate of said deceased coming into her hands or under her control, has paid the cost€
<br />of administration and all claims filed and allowed against said estate, and has paid the funeral
<br />expenses, the expense of the last illness, and all other claims against said estate.
<br />The court finds that due and legal notice was given to all creditors of the said Fritz Horst, de-
<br />ceased, of the time limited and place appointed for filing claims against the estate of said de-
<br />ceased, and that the time allowed creditors for filing claims has fully expired; that all claims
<br />outstanding against said deceased not so filed, if any such exist, are therefore, forever, barree
<br />and excluded.
<br />It is therefore considered and adjudged by the court that the report of said executrix be and the
<br />same hereby is approved and allowed as and for her final account and she is discharged of her
<br />trust.
<br />It is further considered by the court that all persons are forever barred from filing or setting
<br />up any claims or demands of whatsoever nature against the estate of Fritz Horst, deceased.
<br />The court further finds that the said Fritz Horst departed this life on the 25th day of December,
<br />1934, that he was at the time of his death, a resident and inhabitant of Hall County, Nebraska,
<br />that he left a last will and testament, which instrument was duly proven, allowed and admitted
<br />to probate in this court on the 4th day of February, 19351 and recorded in this office,
<br />The court further finds that the said Fritz Horst died seized of the following described real
<br />estate situated in-Hamilton County, Nebraska, to -wit:
<br />The Northwest Quarter of the Northwest Quarter (NWJ NW4) of Section 29, Township 10, North of
<br />Range 91 West of the 6th P.M. Hamilton County, Nebraska, containing 40 acres, a little more or
<br />less, according to the government survey.
<br />The Southeast Quarter (SE4) of Section 192 township 10, north of Range O, containing 160 acres,
<br />little more or less according to the government survey, Hamilton County, Nebr.
<br />The Northwest Quarter (NWJ) of Section 302 Township 10, North of Range g west of the 6th P.M.,
<br />containing 160 acres, a little more or less, Hamilton County,Nebr.
<br />The North Half of the Southwest Quarter (N2 SWJ) of Section 30, township 10, north of Range S,
<br />West of the 6th P.M. in Hamilton County, Nebraska, containing 80 acres, a little more or less.
<br />The Easterly 392 feet of Lot S in Block 15 in Russel Wheelers addition to the City of Grand Isla:
<br />according to the recorded plat thereof.
<br />The court further finds that under and by virtue of the provisions of the last will and testamen
<br />of Fritz Horst, deceased, Mary Horst, surviving widow, was bequeathed all of the personal proper
<br />and all of the real property owned by the said Fritz Horst at the time of his death, she to have
<br />the use, income and profit thereof during her lifetime, and that in the event that it should bec
<br />necessary for her to use any of said estate, in addition to said life income, she was granted th
<br />right and authority to use so much of said estate as she might deem necessary.
