2 81x.1 <br />co. 4427.533 <br />a resident of said Hall County, Nebraska, though temporarily absent at that time, leaving a last I <br />will which was duly admited to probate in this Court,on the 3rd day of August, 1933, said matter <br />having been continued from the 26th day of July, 1933, by agreement of all interested parties; <br />that said will is in words and figures as follows, to -wit: <br />LAST WILL AND TESTAMENT <br />I. Bertha T.Mead, a resident of Grand Island,Nebraska, do hereby make, publish and declare this <br />instrument to be my last will and testament in manner and form as follows: <br />First: I direct that all of my just debts and including the expenses of my last illness and funer <br />shall be first paid and as soon after my decease as conveniently can be done. <br />Second: Subject only to the payment of such debts and expenses as above mentioned, I give, Bevis <br />and bequeath all of the rest, residue and remainder of my estate, be the same real or personal <br />property of which I may die seized and possessed or to which I may be entitled at the time of my <br />death, to my husband John Fletcher Mead for and during the term of his natural lifetime. I furtb <br />give, devise and bequeath to him so much of the principal of my estate as he may find necessary t <br />use for his comfort and support and he shall be the sole judge of what amount may be necessary for <br />p that purpose. <br />Third: After the death of my husband, I give, devise and bequeath the net income from my estate <br />which may.then be remaining.to my sister Stella B.Romberg for and during the term of her natural <br />lifetime. It is my intention that after the death of my husband my executor hereinafter named <br />shall keep my said estate invested and shall pay for the upkeep insurance and taxes out of the <br />i <br />income therefrom, and the remainder of said income he shall pay to the said Stella B.Romberg. I <br />s direct my said executor to make such payments to her as often as conveniently can be done and at <br />least once each year. <br />y <br />Fourth: All the rest, residue and remainder of my estate which gay remain after the death of my <br />1 <br />f <br />husband, and the said Stella B.Romberg, be the same real or personal property, I give, devise and <br />bequeath to my son Leo S.Mead to have and to hold absolutely and forever in fee simple. <br />i <br />Fifth: It is my intention and I so direct that when the point is reached in the settlement of my <br />estate that the debts and expenses have been paid and an order has been entered barring claims the <br />my entire estate shall be turned over to my husband and he shall have the absolute contral of the <br />same during his lifetime with the same power to invest and use the same as I would have had if lit <br />ing. At his death my executor hereinafter named shall again take possession thereof for the pur- <br />pose of carrying out the further provisions of this will. <br />Sixth: I hereby nominate and respectfully request the Court to appoint my son Leo S.Mead execut03 <br />of this my last will and testament and it is my wish that he be permitted so to act with6ut bond. <br />Seventh: I hereby revoke and annul any and all former wills by me at any time heretofore made. <br />IN WITNESS WHEREOF I have hereunto set my hand at Blair, Nebraska, this 14th day of April, 1932. <br />In presence of: <br />Myr6n R.Brock Bertha T.Mead <br />A.C.Debel <br />We whose names are hereto subscribed, do hereby certify that the foregoing instrument was signed, <br />published and declared by Bertha T.Mead as and for her last will and testament in our presence an <br />hearing, and in the presence and hearing of both of us this 14th day of April, 1932; that we at <br />the same time, at her request, in her presence, and in the presence of each other subscribed our <br />names thereto as attesting witnesses. We further certify that when the said testatrix signed sai <br />instrument and declared the same to be her last will and testament she appeared to us to be of so <br />mind and memory, free from restraint and undue influence, and in every way competent to make her <br />will.
