<br />given by the Court, in the manner provided by law, and that on the 8th day of April, 1926, the date

<br />fixed for said purpose, said instrument was duly proven, a an p
<br />Court as and for the last Will and Testament of said Catharine Baumann, deceased, and Letters-Tes
<br />tamentary were duly issued thereon to Remmert Baumann, Executor named in said last Will and he
<br />duly qualified as such.
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for the presentation of claims against said estate and the time so fixed
<br />has duly expired and that all persons having claims against said estate, if any such there be, are
<br />Iforever barred and ex6luded from setting up or asserting any such claims.
<br />The Court further finds that the said Catharina Baumann died seized as the owner in fee simple of
<br />the following described real estate;
<br />The Northwest Quarter of the Northwest Quarter of the Northeast Quarter of Section 4 Township 11
<br />North of Range 9 West of the 6" P.M. Hall County, Nebraska, containing 10 acres be the same a little
<br />more or less;
<br />that said real estate appears of record in the name of Catharina "Bauman ", but that the true name
<br />of the owner of said real estate is Catharina "Baumann", the deceased, and that Catharina "Bauman
<br />and Catharina "Baumann" are the same persons; that by the terms and provisions of the last Will
<br />Testament of the said Catharina Baumann, deceased, the said real estate was given, devised and be
<br />queathed unto the surviving husband, Remmert Baumann, and that said real estate thereby and under
<br />and by the provisions of said last Will and Testament descended to the said Remmert Baumann in fee
<br />simple.
<br />The Court further finds that the said Catharina Baumann left surviving her her husband, Remmert
<br />Baumann, and one son, Theodore Baumann, and that by and under the provisions of said last Will,
<br />said Theodore Baumann is entitled to a special bequest of Five ($5.00) Dollars, which said be-
<br />quest has been paid and the voucher for same is on file with this Court.
<br />The Court further finds that all claims filed against said estate have been paid and that all
<br />Cher claims, if any such there be, are forever barred; that the said Remmert Baumann, executor, h
<br />paid the funeral expenses of said deceased, the costs of this proceedings, the special bequest or
<br />legacy provided for in said Will and all claims-existing against said Estate, that the said Remme
<br />Baumann has collected no money or personal property of any kind or nature and that said costs,cla
<br />funeral expenses and other lawful indebtedness were paid by him and that he makes no claims against
<br />the estate for reimbursement for the amounts so paid by him, and that nothing belonging to said es-
<br />tate excepting the real estate hereinbefore described remains in his hands as such executor.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that the final report of said Remmert
<br />Baumann, as executor of the last Will and Testament of Catharina Baumann, deceased, be and the same
<br />Is hereby approved and allowed as and for his final report; said estate is hereby settled and closed,
<br />the executor discharged and his bond as such is hereby released.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that Remmert Baumann, the surviving husband
<br />is the sole and only devisee under the last Will and Testament of the said Catharina Baumann, de -1

<br />ceased and that all the rights, titles and interests of the said Catharina Baumann in and to all
<br />of the following described real estate, to -wit:
<br />The Northwest Quarter of the Northwest Quarter of the Northeast Quarter of Section 4 Township 11
<br />North of Range 9 West of the 6" P.M. Hall County, Nebraska, containing 10 acres be the same a
<br />little more or less,
<br />did pass and descend at her death to the said Remmert Baumann in fee simple and that he is the

<br />owner of said real estate absolutely and forever; that the legacy in the amount 8405.00) Dollars
<br />to Theodore Baumann, a son of the deceased, Catharina Baumann, has been paid and that there are
