That on the 4th day of October, 1934, said <br />instrument to which this certificate is attached was duly proved, probated and allowed as the <br />last will and testament of the real and personal estate of said Peter Sander deceased, and the a& <br />was ordered to be recorded in the records of the -Court aforesaid. <br />IN WITNESS WHEREOF I have hereunto set my hand and affixed the seal of the County Court this 4th <br />day of October, 1934• <br />Paul N.Kirk <br />(SEAL) County Judge <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />IN THE MATTER OF THE ESTATE OF j <br />PETER SANDER, DECEASED. ) <br />FINAL DECREE. <br />Now on this 23" day of April 1935, this cause came on for hearing upon the final report filed here <br />by Harry J.Sander, Executor of the estate of Peter Sander, deceased, and upon his petition for the <br />approval and allowance of said report, settlement of said estate and his discharge as Executor of <br />said estate and the Court having examined the records and files herein, including said report and <br />the vouchers attached thereto and being fully advised in the premises, finds as follows: <br />That on the 8th day of September, 1934, the said Harry J.Sander filed his petition in the Court Jn <br />which he alleged among other things that Peter Sander departed this life at his residence in said <br />County on the 8th day of August, 1934, leaving a Last Will and Testament, in which your petitioner <br />was named Executor thereof, which instrument he offered for probate as the Ladt Will and Testament <br />of said deceased and asked that he be appointed Executor thereof; that upon reading and filing of <br />said petition, this Court entered an order - fixing the time and place for hearing said petition and <br />gave notice thereof as provided by law;, and that said matter coming on to be heard upon the day <br />fixed by the Court, said instrument was duly admitted to probate in this Court as the Last Will an <br />Testament of said deceased and letters of administration were issued to Harry J.Sander. <br />That due and legal notice has been given to all persons of the time and place fixed by,the Court <br />for filing claims against said estate, and all persons having claims against said estate not filed <br />within the time fixed by the Court, if any such there be, should be forever barred, excluded and <br />enjoined from setting up or asserting any such claims against said estate. <br />That said deceased departed this life leaving as his heirs -at -law and only heirs -at -law, devisees <br />and legatees and persons entitled to share in his said estate the following named persons: <br />John Sander, a son, Grand Island,Nebraska, <br />Harry J.Sander, a son, Grand Island,Nebraska, <br />Mathilda M.Sander, a daughter, Grand Island,Nebraska. <br />Ella Muhl, a daughter, Grand Island,Nebraska, <br />Anna Sander, a daughter, Grand Island,Nebraska, <br />Martha Pepper, a daughter, Grand Island,Nebraska, <br />all being of legal age; that said deceased departed this life the owner in fee simple, in and to <br />the following described real estate, situated in Hall County, Nebraska, to -wit: <br />Lot Six (6) in Block One Hundred Three (103) in Koenig and Wiebe's Addition to the City of Grand <br />Island;Hall County, Nebraska, <br />and that said real estate hereinbefore described did pass and descend under the terms of said Last <br />Will and Testament, to Harry J.Sander, Mathilda M.Sander, Anna E.Sander, Martha Pepper, Ella E. MuY. <br />and John H.Sander, in equal shares, share and share alike, in fee simple, subject however to the <br />exclusive use and occupancy of Harry J.Sander, Mathilda M.Sander and Anna E.Sander so long as they <br />or either of them may choose to make said property their home; <br />t the final report filed herein is true and co <br />n <br />
