<br />Now on this 7th day of March, 1935, this cause came on for hearing upon the petition of Mary J.
<br />West, praying for the settlement of said estate, for a determination of the heirship and right of
<br />descent of the real estate belonging to Arthur Ewing and the degree of- kinship of his heirs at
<br />law, and a decree settling his estate.
<br />AND IT APPEARING TO THE COURT from the proofs on file herein that due and legal notice has been
<br />given by publication for three successive weeks, as by law and the order of this court provided,
<br />to all creditors, heirs at law, and other persons interest in said estate, of the filing of said
<br />petition, and of the time and place fixed for the hearing of the same, and there being no object
<br />thereto, this cause was duly submitted to the court upon the petition and the evidence in support
<br />thereof, and the court being duly advised in the premises finds that the allegations in said peti
<br />tion are true, and that said petitioner Mary J.West is the owner of the ,East Half of the Southeast
<br />Quarter (E* SEi) of Section Four (4) in Township Ten (10) North, of Range Twelve (12), West of the
<br />Sixth Principal Meridian, and is a competent and proper person to prosecute this proceeding, that
<br />the said Arthur Ewing died in-testate in Hall County, Nebraska on the 31st day of December, 1888,
<br />and at the time of his death, the said Arthur Ewing was a resident and inhabitant of Hall County,
<br />Nebraska, and died seized in fee simple title to a one -ninth interest in the following property,
<br />to -wit: The East Half of the Southeast Quarter (E* SEJ) of Section Four (4) in Township Ten (10)
<br />North, of Range Twelve (12) West of the Sixth Principal Meridian, in Hall County, Nebraska, and
<br />that more than forty years have elapsed since his death, that no application has ever been made
<br />in the state of Nebraska, for the appointment of administrator of his estate, and no petition
<br />filed for that purpose, and no administration has ever been had upon the estate of Arthur Ewing,
<br />deceased.
<br />The Court further finds that the said Arthur Ewing left surviving him as his only heir at law,
<br />his mother Alma E.Ewing.
<br />The Court further finds that under the laws of the state of Nebraska, in force at the time of the
<br />death of the said Arthur Ewing, the real estate hereinbefore described, passed and descended to
<br />his mother, Alma E.Ewing.
<br />The Court further finds that the funeral expenses of said deceased have been fully paid and that
<br />all debts of the deceased and of his estate, if any such existed, are forever barred and precludes
<br />and that the costs of these proceedings have been paid.
<br />It is therefore ordered, adjudged and decreed by the court that the said Arthur Ewing died intes-
<br />tate in Hall County, Nebraska, on the 31st day of December, 1888, that more than forty years have
