<br />IT IS FURTHER ORDERED ADJUDGED AND DECREED by the court that a f inal decree be entered in the
<br />estate of James Ewing,deceased, that said decree shall provide for the re- opening of said estatq
<br />and for an amendment to the inventory filed therein as above set forth, and that a finding be
<br />made by this court that said James Ewing was the owner of an undivided one -ninth interest in the
<br />East',half< 4f_the Southeast Quarter (EJ SE`) of Section Four (4) in Township Ten (10) North, of
<br />Range Twelve (12) West of the 6th P.M. in Hall County, Nebraska, and that the same passed and
<br />descended to his wife and son as above set forth and that the said Mary J.West is now the owner

<br />Now on this 15 day of March, 1935, this cause came on for hearing upon the petition of Mary J.
<br />West, to re -open said estate, to amend the inventory filed therein and to enter a final decree,
<br />and the court heretofore having entered an order finding that.the application of Mary J.West
<br />should be granted and the court being fully advised in the premises finds that the said James
<br />Ewing departed this life on the 31st day of October, 1889, that Charles S.Thompson was appointed
<br />administrator of his estate on December 10, 1999, that notice was given to the creditors of the
<br />said James Ewing, deceased, of the time fixed and the place appointed for the filing of claims
<br />against said estate, that said time has expired and that all claims filed against said estate
<br />have been fully paid and settled and that any claims not so filed are forever barred.
<br />The court further finds that the said James Ewing was the owner of the following described real
<br />estate, to -wit: Lots five (5) and six (6) in block sixteen (16� of the village of Woad River,
<br />Nebraska; the undivided one ninth interest in and to the East half of the Southeast Quarter (Ei
<br />SEJ) of Section Four (4), in Township Ten (10), North, of Range Twelve (12) West of the 6th P.M.
<br />in Hall County, Nebraska.
<br />The court further finds that the said James Ewing departed this life intestate; that his sole
<br />and only heirs at law were Alma E.Ewing, his widow, and Arthur Ewing, his son, and that the above
<br />described premises passed.and descended to the said Alma Ewing, and Arthur Ewing, in equal shares
<br />to each subject to the homestead right of the said Alma Ewing in and to Lots five (5) and Six (6)
<br />in block sixteen (16) in the village of Mood River, Nebraska.
<br />The court further finds that the inventory herein filed by the said Charles S.Thompson should be
<br />amended to include the undivided one -ninth interest in and to the East half of the Southeast
<br />Quarter of Section Four (4) Township Ten (10),North, of Range Twelve (12) West of the 6th P.M.
<br />in Hall County, Nebraska, and the said estate is hereby re- opened for the purpose of permitting
<br />said amendment to include said real estate in said inventory.
<br />The court further finds that due notice was given to all persons of the filing of the report of
<br />the administrator in said estate, and that due notice has been given to all persons having an
<br />Interest in said estate, of the filing of the application of Mary J.West and the said Mary J.
<br />West, being now the absolute owner of said premises, that the application filed by her should
<br />be granted and allowed.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the court that the said James Ewing was the
<br />owner of the undivided one ninth interest in and to the East half of the Southeast Quarter (E *S
<br />of Section Four (4) Township Ten (10) North, of Range Twelve (12) West of the 6th P.M. in Hall
<br />County, Nebraska; and Lots Five (5) and Six.(6) in Block Sixteen (16) of the village of Wood
<br />River, at the time of his death,that it passed and descended to his wife, Alma E.Ewing and Arthu
<br />Ewing, his son, in equal shares subject to the homestead rights of the said Alma E.Ewing in Lots
<br />
