<br />OF FINAL DECREE.
<br />DIEDRICH NIETFELD, DECEASED.
<br />Now on this 26th day of February, 1935, this cause came on for hearing upon the final report of
<br />Dietrich Nietfeld,Jr. executor of the last will and testament of Diedrich Nietfeld, deceased, an
<br />upon his petition for a final settlement of said estate and his discharge herein, and the Court
<br />having examined said report and the records and files in said estate, and being duly advised in
<br />the premises, finds that due and legal notice has been given to all persons interested in said
<br />estate of the time and place fined for the hearing upon said report, as heretofore ordered by tb
<br />Courts and no one appearing to object to said final report, the Court finds that said report is
<br />true and correct in all things and ought to be approved and allowed as and for the final report
<br />of said executor.
<br />The Court further finds that the said Diedrich Nietfeld, departed this life testate on the 3rd
<br />day of,February, 19341 and at the time of his death he was a resident and inhabitant of Hall Cou
<br />Nebraska.
<br />The Court further `finds that on the 7th day of February, 1934, Dietrich Nietfeld Jr., filed in
<br />this Court, his duly verified petition praying for the allowance and probate of an instrument
<br />purporting to be the last will and testament of said Diedrich Nietfeld, and the Court thereupon
<br />fixed the 6th day of March, 1934, as the date for making proof of said last will and testament,
<br />and due notice of the filing of said petition and of the time and place fixed for the hearing
<br />thereof was given by the Court in the manner provided by Law, and on said date, March 6th, 1934,
<br />said instrument was duly proven, allowed and admitted to probate in this Court, as and for the
<br />last will and testament of Diedrich Nietfeld, deoeased, and letters testamentary were duly issue
<br />thereon to Dietrich Nietfeld Jr.,as.:named in said last will and testament, and he thereupon qua]
<br />if ied as such.
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed for the presentations of claims against said estate and that the time so fixed has
<br />fully expired and that all persons having claims against said estate, if any such there be, are
<br />forever barred and exbluded from setting up or asserting any such claims against said estate.
<br />The Court further finds that there is no inheritance tax due on said estate.
<br />The Court further finds that after the payment of debts and the expenses of administering said
<br />estate, as well as the payment of the widow's allowance, Dietrich Nietfeld Jr., executor of said
<br />estate has assigned to Dora Nietfeld, widow of Diedrich Nietfeld deceased, one -third (1/3) of tb
<br />personal property and that he has assigned to Dietrich Nietfeld,Jr., as testamentary trustee the
<br />remaining two - thirds (2/3) of said personal property, which latter two- thirds of said personal
<br />property according to the terms and conditions of the last will and testament of said Diedrich
<br />Nietfeld, deceased, is to be held by Dietrich Nietfeld Jr. and invested by him and the income
<br />therefrom is to be given to Dora Nietfeld, widow, so long as she remains unmarried, but in the
<br />event of her marriage or death the same is to be divided equally between Lena Thompson, Clara
<br />Coleman, Catherina Kroeger, Margaret Roennfeldt, Diedrich Nietfeld,Jr., Emma Nietfeld, Lydia
<br />Nietfeld and Louise Nietfeld, share and share alike.
