V <br />;upon the day fixed by the Court an order was entered finding that said deceased departed this <br />=life intestate the owner of an estate to be administered in said County and State and the appoin <br />ment of said petitioner as administrator of said estate was thereby confirmed. <br />E That due and legal notice has been given to all persons of the time and place fixed by the Court <br />for filing claims against said estate, and all persons having claims against said estate not fil <br />within said time, if any such there be, should be forever barred, excluded and enjoined from setti <br />up or asserting any such claims against said estate. <br />That said deceased departed this life leaving as his heirs -at -law, and only heirs -at -law, deviseeE <br />and legatees, and persons entitled to share in his estate the following named persons: <br />latherine Frederick, surviving widow, residing at Wood River, Nebraska; Owen Frederick and Otto <br />Frederick, sons, the former residing at Wood River, Nebraska, and the latter at Fort Worth,Texas. <br />That said deceased departed this life the owner of an estate consisting of both real and personal <br />property, said personal property being reduced to cash in the amount of $513.94 and expended in <br />payment of debts allowed against said estate and administration costs of administering said estate <br />"leaving a balance of $178.72 to be distributed in equal shares to the three heirs of said decease , <br />I the widow having waived her widow's allowance and other special allowances and exemptions provide <br />by law, and said real estate described as the undivided one -half interest in fee simple in and to <br />Lot Four (4), Block One (1) Dodd & Marshall's Addition to the Village of Wood River, Hall County, <br />Nebraska, which did descend at the death of said deceased to Katherine Frederick, surviving widow, <br />and to the two sons, Owen Frederick and Otto Frederick in equal shares, each taking a one -third <br />part therein, subject however to said surviving widow's homestead rights in and to said real estate. <br />That the final report filed herein by said Administrator is true and correct in all things, and that <br />the same ought to be approved and allowed as and for said Administrator's final report, said esta <br />settled and closed and said Administrator discharged and released from any further liability in <br />said matter. <br />That said estate is not subject to the payment of any inheritance tax either under the laws of the <br />State of Nebraska or the laws of the United States. <br />That said surviving widow's given name has sometimes been written as Katherine and sometimes as <br />Catherine, and that wherever it appears in the records of this probate or any other proceedings <br />as Katherine or Catherine it refers to one and the same person, the wife of George Frederick, <br />deceased, and surviving widow and one of the heirs -at -law of said estate. <br />IT IS THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report filed herein by <br />said Administrator be, and the same is hereby approved and allowed as and for said Administrator's <br />final report, said estate settled and closed and said Administrator and his bondsmen released from <br />any further liability in said matter. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that any and all persons having claims <br />against said estate, not filed within the time fixed by the Court, if any such there be, are for- <br />ever barred, enjoined and excluded from setting up or asserting any such claims against said estate. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that the balance of the personal propert <br />and the real estate, hereinbefore described, in the findings of this decree, did pass and descend <br />at the death of said deceased,: by virtue of the Statutes of Descent of the State of Nebraska, p <br />taining to the descent of real and personal property, to Katherine Frederick, surviving widow, anc <br />two sons, Owen Frederick and Otto Frederick, in equal shares, each taking an undivided one -third <br />part therein, subject however, to said widow's homestead rights therein, and distribution thereof <br />is hereby accordingly made. <br />BY THE COURT: <br />Paul N.Kirk <br />County Judge. <br />
