<br />f4. That on said day all the heirs at law, legatees and devisees under said Will filed their volun -1
<br />tary appearance, waived the issuance and service of notice and the Court made an order that hearinj
<br />be had on the 17th day of January, 1911, at 3 o'clock P.M.,, without further notice.
<br />5. That on the 17th day of January, 1911, hearing was had, proofs taken and a decree of probate
<br />duly executed, proving, approving, probating and allowing said instrument as the last Will and
<br />Testament of the said Elizabeth Rainforth, deceased, and directed that Letters of Administration
<br />with the Will annexed should issue to Files C.Rainforth upon his filing bond in the sum of
<br />$50,000.00 with sureties to be approved by the Court and taking and filing the oath required by la
<br />6. That the said Miles C.Rainforth on said day duly qualified by filing bond with sureties which
<br />was approved by the Court and taking and filing the oath required by law, and thereupon Letters of
<br />Administration with the Will annexed were duly issued to him and he entered upon the discharge of
<br />his duties as such Administrator.
<br />7. That on said day the Court made an order fixing the lath day of February, 1911, at 10 o'clock
<br />A.M., at the County Court Room in Hastings, Nebraska, as the time and place for the filing, exam-
<br />ination and adjustment of claims against said estate and directed that all claims not filed on ,sai
<br />day, so limited, or within six months thereafter should be forever barred and further directed tha
<br />notice of such order should be given by the publication of a copy thereof in the Hastings Daily
<br />Republican, a newspaper printed, published and of general circulation in said County for four week
<br />prior to said day of hearing.
<br />8. That notice was given by the publication of a copy of said order in the Hastings Daily Republic
<br />as directed, and that proof of the due publication thereof was filed with this Court on the 7th da
<br />of March, 1911.
<br />9. That the time limited for the filing, examination and adjustment of claims against said estate
<br />has long since expired and that all claims filed and allowed have been fully paid, including costs
<br />of administration and that all claims not filed have become barred by the Statute of Limitation an
<br />that there are no appeals pending from the disallowance of any claim.
<br />10. That the said Elizabeth Rainforth died seized of the following described real estate, to -wit:
<br />The North Half (NJ) of Section Thirty -one (31) Township Nine (9) Range Ten (10),West of the Sixth
<br />P.M. , Hall County, Nebraska.
<br />11. That by the terms of said last Will and Testament, all of the real estate of said deceased
<br />was devised to Richard Rainforth, husband of said Elizabeth Rainforth, for the term of his natural
<br />life, and at his death said property to go to Miles C.Rainforth, Thomas R.Rainforth, William H.
<br />I .
<br />Rainforth, John E.Rainforth, Albert P.Rainforth, Arthur H.Rainforth and Frederick M.Rainforth, share
<br />and share alike.
<br />12. That the said Richard Rainforth departed this life on the 26th day of November, 1910, being
<br />prior to the death of said Elizabeth Rainforth and that the only heirs at law and only persons
<br />interested in said estate are as follows:
<br />Miles C.Rainforth, son, of Doniphan, Nebraska;
<br />Thomas R.Rainforth, son, of Hastings, Nebraska;
<br />William H.Rainforth, son, of Prosser, _Nebraska;
<br />John E. Rainforth, son, of Litchfield, Nebraska;
<br />Albert P.Rainforth, son, of Lacomb, Alberta, Canada;
<br />Arthur H.Rainforth, son, of Doniphan, Nebraska; and
<br />Frederick M. Rainforth, son, of Doniphan, Nebraska;
<br />all being over the age of 21 years.
<br />13. That subsequent to the execution of said Will, said Elizabeth Rainforth and her husband,
<br />Richard Rainforth made, executed and delivered a contract agreeing to convey the North East Quartet
<br />(N.E.i) of Section Thirty -one (31)2 Township Nine (9), Range Ten (10), West of the Sixth P.M. Hall
<br />County, Nebraska, by Warranty deed to Arthur H.Rainforth, one of the heirs of said deceased, for
<br />the sum of $14,500.00; also made, executed and delivered a contract agreeing to convey the North
<br />West Quarter (N.W. +) of Section Thirty -one (31), Township Nine (9), Range Ten (10) West of the
