<br />FINAL DECREE.
<br />Upon motion of Arthur C.Mayer, attorney for the above named estate, this matter came on to be hear
<br />upon the final report of Henry Staack, administrator of the estate of Richard Spoerke, deceased,
<br />upon examination of the files, examination of receipt filed with said report and argument of couns�l,
<br />the Court finds that said report was filed in this Court on the 7th day of March, 19062 in its due
<br />and proper form and should be allowed as the final report of said administrator.
<br />The Court further finds that due and legal notice has been given of the filing of the final report
<br />of said executor in the Free Press, a legal newspaper published in said Hall County, and that time
<br />for filing objections thereto has long since expired and that no objections have been filed or has
<br />any person appeared in opposition to said report.
<br />IT IS THEREFORE ORDERED that said report be deemed and considered the final report of said adminis.
<br />tr ator, that the same is true and correct and that said administrator should be discharged and his
<br />bond released from further liability.
<br />The Court further finds that said Richard Spoerke departed this life on the 5th day of February,
<br />A.D. , 1999, intestate, a resident of Grand Island,Hall County, Nebraska, seized of an undivided
<br />one-half interest in Lot 91 Block 14 of the Original Town, now City of Grand Island, Hall County,
<br />Nebraska, according to the recorded plat thereof; that said premises constituted the homestead of
<br />the deceased and his family, and that he left surviving him Johanna Spoerke, his widow, and George
<br />Spoerke May Spoerke, Ella Spoerke, Elsie Spoerke and Richard Spoerke, his children, who, with said
<br />widow, constitute the family of the deceased, and that he left no other property excepting househo$d
<br />goods of the value of $100.00, the property of said widow and exempt under the laws of this State;
<br />that said real estate at the time of the decease of said Richard Spoerke, was worth no more than
<br />$1200.00 and the undivided one -half interest of the deceased, worth not more than $600.00;
<br />That Henry Staack was duly appointed administrator of said estate after said Johanna Spoerke, in
<br />open Court, refused to act and qualify as the administratrix thereof and said Henry Staack qualifi
<br />as by law provided: and entered upon the duties of that office; that this Court made an order fix-
<br />ing the 26th day of August, 1599, as the time when all claims against said estate shall be on file
<br />and heard and that due notice of said order was given in the Grand Island Independent, a legal
<br />newspaper printed in said Hall County and of general circulation therein, and published four con -
<br />secutive weeks in said newspaper; that all claims filed have been paid and that there are no unpai,
<br />claims against said estate.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that all claims have been paid against the deceased
<br />and his estate, and that all persons be enjoined from filing further claims herein and that no fu
<br />ther claims be filed.
<br />The Court further finds no record that the costs herein have hot been paid and finds a receipt on
<br />file showing the payment of the publication notice on said final report and the Court therefore
<br />finds that all costs have been paid in this matter and that said estate should be closed.:.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED that all things necessary herein to be done have been
<br />done and that this estate be closed.
<br />The Court further awards an undivided one -half interest in Lot 8 Block 14 of the Original Town,
<br />Now;: City of Grand Island,Hall County, Nebraska, to George Spoerke now aged 48 years of age, to
<br />May Spoerke now aged 43 years of age, to Ella Spoerke now aged 42 years of age, to Elsie Spoerke
<br />now aged 37 years of age, and Richard Spoerke now aged 35 years of age, subject, however, to the
<br />life estate of the said Johanna Spoerke for and during the term of her natural life.
