172 TNk AUGUSTINECO. 8 7- 5 -33. 4 of America, to be collected under the terms and provisions of said agreement and the Internationale_ Harvester Company is hereby precluded from setting up or making any further claim against the esta rof Harry N.Oldson, deceased. i R The court further finds that the said Martha H.Oldson has received the sum of Seventeen hundred fifty and no /100 Dollars ($1750.00 ) proceeds of the sale of the real estate above described, and that she has accepted the same in payment of the bequest contained in the second paragraph of the last will and testament of Harry N.Oldson, deceased, and has filed a receipt for the payment therE of. The court further finds that the trust established under the third paragraph of said will cannot I carried out until the notes, accounts, claims and mortgages held as collateral by the InternationE Harvester Company of America are collected and settled and that said estate should be closed and settled, -and the executrix thereunder released and discharged. The court further finds that said estate was not subject to inheritance tax and that the costs of probating said estate have been fully paid. It is therefore ordered by the court that said estate is closed and settled and that the executrij is hereby discharged and her bond released, that any funds remaining in the hands of the Interna- tional Harvester Company after the terms of the contract heretofore entered into have been carriec out, shall be reported to this court, and an order shall then be entered with reference to the disposition thereof in accordance with the terms of said will.
