The Court further finds that the court costs have been paid and that neither this estate nor the respective heirs are liable to the payment of any estate or inheritance taxes, whether Federal or State, and the executor is relieved from any payment of any such dues, taxes or assessments. The Court further finds that according to said will, Gehrd Schmidt was devised the northeast qua ter of Section 22, Township 188 North, Range 12, West of the 6th P.M., Greeley County, Nebraska, and said premises are hereby awarded to him and to his heirs and assigns forever; That said will devised Lots 63 and 64, 67 and 69 in Hawthorne Place, a subdivision of the northwe�t quarter of Section 22, Township 12 North, Range 9, within the City of Grand Island,Hall County, Nebraska, to John Schmidt, his son, and the same is hereby awarded to him and to his heirs and assigns forever. To Anna Schmidt Shealds, also known as Anna Schmidt Shields, said testator devised the North Half of the North Vest Quarter of Section 23, Totirrnship 9 North, Range 91 Vest of the 6th P.M. in Hall County, Nebraska; that said Anna Schmidt Shields departed this life intestate on the 7th day of November, 1932, leaving surviving her her husband Clabe and the following children, her heirs at law and only heirs at law., to -wit: Mederick D. Shields, Floyd W. Shields, Judson C. Shields, Marjori Shields, Elane Shields, Deloris Shields, Burdetta Shields and Anita blields, and the Court hereby awards said North Half of the Northwest Quarter of Section 23, Township 9 North, Range 9 to Mederick D.Shields, Floyd W.Shields, Judson C.Shields, Marjorie Shields, Elane Shields, Deloris Shields, Burdetta Shields and Anita Shields, in like parts, share and share alike, And to their heirs and assigns forever. To 7Minna Schmidt Decker, said testator devised the South Half of the North West Quarter of said Section 23, Township 9 North, Range 9, West of the 6th P.M., Hall County, Nebraska, and the same is hereby awarded to her and to her heirs and assigns forever. To Lena Schmidt Shealds, also known as Lena Schmidt Shields, said testator devised the North Half of the South West Quarter of Section 23, Township 9 North, Range 9, West of the 6th P.M., Hall County, Nebraska, and the same is hereby awarded to her and her heirs and assigns forever. The Court further finds that a part of said estate was a real estate mortgage executed by Herman Kruse and his wife Bertha upon the North Half of the North East Quarter of Section 3 in Township 14 North, Range 9 West of the 6th P.M. in Howard County, Nebraska, in the amount of $3500.00 and that in settlement of said note and mortgage, said Herman Kruse and his wife conveyed said premises to the executor of this estate for the use and benefit of the heirs and legatees in said will and that said executor holds said premises in trust for said heirs and devisees. The Court therefore awards said North Half of the North East Quarter of Section 3, Township 141 North, Range 9, West of the 6th P.M. in Howard County, Nebraska, as follows: To ,John Schmidt an undivided one -fifth interest in said premises, to him and to his heirs and assigns forever, to Gehrd Schmidt, also known as George Schmidt, an undivided one -fifth interest in said premises, to him and to his heirs and assigns forever; to Minna Schmidt Decker an undivided one -fifth interest in said premises, her and to her heirs and assigns forever; to Lena Schmidt Shealds an undivided one -fifth interes in said premises, to her and to her heirs and assigns forever; to Mederick D.8hields, Floyd W. Shields, Judson C.Shields, Marjorie Shields, Elane Shields, Deloris Shields, Burdetta Shields and Anita Shields, an undivided one - fortieth each, to them and to their heirs and assigns foreve$. The Court finds that the rest, residue and remainder of said estate has been divided into five equal parts, that part which would have gone to Anna Schmidt Shields has been paid to her heirs and such of her heirs as are minors are represented by Clabe Shields, their guardian, to whom their respective shares have been paid. The Court finds that everything that should have been done has been done and this estate should be closed and it is ordered closed. Witness my hand this 22nd day of December, 1934.
