148 <br />t the said Jesse C.Walker died intestate on the 27th day of February, A.D. 1934; a resident of <br />Hall County, Nebraska• and left surviving him a widow, the said Agnes J.Walker, a son, Donald J. <br />Walker, daughters, Jo Anna Walker and Mrs. Marjorie E.Spahr; that he left no other living children, <br />or the living issue of any deceased children, and that the said Agnes J.Walker, Donald J.Walker, <br />Jo Anna Walker, and Mrs. Marjorie E.Spahr are the sole and only heirs of his estate. <br />111. <br />That the real estate hereinbefore described be and is hereby assigned to the said Agnes J.Walker, <br />widow of the decedent, as a homestead for her use and benefit during the term of her natural life. <br />iv. <br />That said real estate hereinbefore described be and the same is hereby assigned to the said Agnes <br />J.Walker, an undivided one -third thereof, and to the said Donald J.Walker, Jo Anna Walker, and Mrs, <br />Marjorie E.Spahr to each an undivided two - ninths thereof, as provided by law, subject to the home- <br />stead rights of the said Agnes J.Walker as herein provided. <br />V. <br />That all of the personal property belonging to said estate and now in the hands of the administrate <br />for distribution be and is hereby assigned to the widow, the said Agnes J.Walker, as provided by <br />law: and pursuant to the written assignment of the said Donald J.Walker, Jo Anna Walker, and Mrs. <br />Marjorie E.Spahr, filed herein. <br />(SEAL) <br />Paul N.
