That on the 26th day of June, 19342 said instrumen <br />to which this certificate is attached was duly proved, probated and allowed as the last will and <br />testament of the real and personal estate of said Louis Graf, deceased, and the same was ordered <br />to be recorded in the records of the Court aforesaid. <br />IN WITNESS WHEREOF I have hereunto set my hand and affixed the seal 6f the County Court this 26th <br />day of June, 1934. <br />In the Blotter of the Estate of <br />(SEAL) <br />Paul N.Kirk <br />County Judge. <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />FINAL DECREE. <br />Louis Graf, Deceased. ) <br />1934 <br />Now on this 27" day of November,,, this cause came on to be heard upon the final report of Emma Graf <br />executz #x and Eddie W.Graf, Administrator with the Will Annexed of the estate of Louis W.Graf, de- <br />ceased, following due notice of the filing of said report and of the time and place appointed for <br />hearing thereon as by law and the order of the court required and no one having appeared to object <br />or protest against the allowance of said report, <br />After a full examination of said report, the court being fully advised in the premises finds that <br />said report is correct in every respect and ought to be allowed, that the executrix and administra. <br />for with the will annexed, have accounted for all property of said deceased coming into their hand <br />or under their control, and that the property remaining in their hands has been by them assigned t <br />Emma Graf as Sole legatee under the provisions of the last will and testament of Louis Graf, de- <br />ceased, and that there remains in their hands no other personal property for distribution. <br />The court further finds that the funeral expense of said deceased, the expenses of his last illnes <br />and all claims filed against said estate have been paid by the executrix and administrator with th <br />will annexed, and receipts for the payment thereof have been filed with the court. <br />The court finds that due notice was given to all creditors of said deceased, as to the time allowe <br />and place appointed for filing claims against said estate, that the time so allowed for filing <br />claims has fully expired, that all claims filed and allowed against said estate have been paid and <br />satisfied and that all claims outstanding against said deceased, or his estate not filed in this <br />office within the time allowed for filing claims, if any such exist, are therefore forever barred <br />and exbluded. <br />It is therefore considered by the court that the report of Emma Graf, Executrix and Eddie W.Graf, <br />administrator with the will annexed, be and the same is approved and allowed as and for their fina <br />account and they are discharged of their trust. <br />The court further finds that there is a suit pending in the District Court of Hall County, Nebrask <br />wherein the said Louis Graf was made a party defendant during his lifetime, and which has been <br />revived against Emma Graf, executrix and -Eddie W.Graf, administrator with the will annexed, which <br />suit is based upon a claim on a written guarantee in favor of the National Bank of Doniphan, that <br />the liability of the said Louis Graf thereon, has not been determined, and from the evidence sub- <br />mitted to the court with reference thereto, the liability of the estate of Louis Graf will probab <br />be less than $1,000.00 and that in order that said National Bank of Doniphan should be protected <br />in the event a judgment is entered against said executrix a:q.d administrator with the will annexed, <br />a bond should be executed by them for the benefit of the National Bank of Dohiphan, in the sum of <br />not less than $2,000.00 and shall provide for the payment to the National Bank of Doniphan, the <br />amount for which said estate may be found liable in said suit which is now pending and that upon <br />filing said bond, the said estate will be relieved from further liability on said claim. <br />It is therefore considered, adjudged and decreed by the court that all persons are forever barred <br />from filing or setting up any claim or demand against the estate of Louis Graf, deceased. <br />, <br />;, <br />
