132 <br />Iestate, and for his discharge from said trust, and the court finds: <br />That due notice has been given by publication as required by, law and the former order of this cour <br />of the time and place of this hearing, and that all of the interested parties are present, and tha <br />the court has jurisdiction of all the interested parties and of the subject matter of this action. <br />In consideration of the evidence and an examination of the files and records herein, the court fir. <br />That George B.Durkee departed this life on the 18th day of May, 1934, a resident of and domiciled <br />in Adams County, Nebraska. <br />d <br />That he left surviving him as his sold heirs at law, next of kin, legatees and devisees and the <br />only persons interested in his estate Minnie B.Christopher and Grace E.Baumann, both daughters; <br />that he left no widow, nor any other child or children, nor the child or children of any deceased <br />child, him surviving. <br />That on the 22nd day of May, 1934, a petition was filed in this court by the daughters above named, <br />praying for the probate of an instrument which they alleged to be the last will and testament of <br />said deceased; that on the 9th day of June, 1934, and after due notice of the filing of said <br />petition and the time and place of hearing thereon had been given by publication as required by <br />law, this court made and entered an order finding that the instrument referred to in the petitions <br />was the last will and testament of said deceased, and this court then entered a decree allowing <br />and probating said instrument as the last will and testament of said deceased; that said will and <br />the decree allowing and probating the same was in words and figures as follows: <br />KL <br />W I L L <br />I, George B.Durkee, of the City of Hastings, Adams County, Nebraska, being of sound mind and memos <br />and considering the uncertainty of this mortal life, do make, declare and publish this instrument <br />as and for my last MILL and TESTAMENT, hereby revoling all former Wills by me made. <br />FIRST. I order and direct the Executor of my estate, hereinafter na.med,to pay all my just debts, <br />funeral expenses ,and costs of administration of my estate, out of my personal estate, the same to <br />be paid as soon after my decease as convenientl'k* may be. <br />SECOND. I give, devier and bequeath unto my daughter Grace E.Baumann, of Hall County, Nebraska, <br />the following described real estate situated in Hall County, State of Nebraska, to- wit: The Nortl <br />east Quarter (N*) of Section Thirty -five (35), Township Nine (9), North, Range Ten (10)West of <br />the Sixth P.M. <br />THIRD. I give, devise and bequeath unto my daughter Minnie B.Christopher, of Hall County, Nebrask <br />the following described real estate situated in Hall County, State of Nebraska, to- wit: The Nort <br />Half (NJ) of Southwest Quarter (SWJ) and the Southeast Quarter (SEA;) of the Southwest Quarter (SW <br />of Section Thirty -six (36)) Township Nine (9) North, Range Nine (9) West of the Sixth P.M. I also <br />y <br />, <br />give and bequeath unto my said daughter, Minnie B.Christopher, all promissory notes and accumulat4d <br />interest on same that may be owing by W.E.Christopher to me at the time of my demise. <br />FOURTH.
