i <br />u <br />1 <br />1 <br />119 <br />No. 6 HALL COUNTY <br />WILL & DECREE. <br />STATE OF NEBRASKA IN THE COUNTY COURT OF SAID COUNTY:' <br />ss. <br />ADAMS COUNTY <br />(At a Session of the County Court held in and for said County, at the County Court Room, in the Ci <br />of Hastings, County of Adams, and State of Nebraska. <br />In the Matter of the Estate <br />of <br />Present: W.Halsey Bohlke,Judge of the <br />County Court. <br />Decree of Final Aneount. <br />and <br />Distribution of Estate. <br />Jacob_ H.Quigle, Deceased. <br />Now on this 20th day of September, 1934, this matter comes on to be heard upon the petition of <br />John C.Quigle, executor of the will and estate of the deceased for final settlement of said estate <br />for the discharge of the executor and for the distribution of the personal property of said estate, <br />and the assignment of the real estate and the evidence, and was submitted to the Court on consider <br />tion whereof the Court finds that due and legal notice of the time and place of hearing on said <br />final account and petition for discharge has been given to all persons interested in said estate <br />provided by law: thereupon the Court being fully advised in the premises finds as follows: <br />That Jacob H.Quigle died testate a resident of Adams County, Nebraska, on the 26th day of March, <br />1934; that by proper proceedings had in this court the will of the deceased was on the 21st day of <br />April, 1934, duly examined, proved, probated, and ordered recorded as such, and a proper certific <br />of probate to be attached to said will; that the will of the deceased and the codicil thereto <br />attached and the certificate of probate are as follows, to -wit: <br />WILL. <br />I't Jacob Quigle of the City of Ha..stings, Adams County, State of Nebraska, being of sound mind and <br />memory and considering the uncertainty of this mortal life, do therefore,make, publish and declare <br />this instrument to be my last Will and Testament, hereby revoking all former Wills by me made. <br />FIRST, I order and direct the Executor of my estate to pay all my just debts and funeral expenses <br />as soon after my decease as conveniently may be. <br />SECOND. After the payment of such funeral expenses and debts, I .give, devise and bequeath unto my <br />wife, Vina Quigle, the sum of One Thousand ($1000.00) Dollars, the same to be paid out of either <br />personal property or real estate belonging to my estate. This bequest is a voluntary gift and is <br />made with <br />Pg. 2 - Decree Estate Jacob H.Quigle,dec'd cont.- <br />the provision that it is in no manner to make void or interfere with the anti- nuptial contract or <br />agreement made in writing by and between Jacob H.Quigle and Vina Wisherd and dated June 21st,1923. <br />The said Vina Wisherd being now Vina Quigle. <br />THIRD, I give, devise and bequeath unto my son, Harry Quigle, the following described real estate, <br />subject however to any and all ecnumberances that may be against said real estate at the time of <br />my death: The Northwest Quarter (NWJ) of the Southwest Quarter (SEJ) of Section Sixteen (16) in <br />Township Nine (9) North, Range Nine (9), West of the 6th F-M., in Hall County, State of Nebraska. <br />Also the following described real estate situated in the City of Hastings, Adams County, State of <br />Nebraska, the south Seventy -six (76) Feet and Nine (9) inches of the West Fifty - three (53) Feet of <br />Lot Three (3) in Block Twelve (12) Hillside Addition to the City of Hastings, Nebraska. <br />FOURTH: I give, devise and bequeath unto my son, Henry Quigle, the following described real estate <br />situated in Hall County, State of Nebraska, subject however to any and all encumbrances that may <br />be against said real estate at the time of my death: The Northeast Quarter of Section Sixteen(16) <br />in Township Nine (9) North, Range Nine (9) West of the 6th P.M. <br />FIFTH, I give, devise and bequeath unto my daughter, Ada M.Mitchelmore, my residence property on <br />St. Joseph Avenue in the City of Hastings, Adams County, State of Nebraska, more particularly <br />e <br />
