<br />The Court finds that the bequests provided for in the fourth paragraph of the last Will and Testament
<br />of said deceased, said bequests being the sum of $1000.00 each to Martha Toben and Anna Toben ha
<br />been paid to said beneficiaries and that their receipts are on file for same.
<br />The Court finds that the said Bernhard Toben departed this life on the 5" day of August, 19202
<br />leaving 4 last Will and Testament which was admitted to probate on the 20" day of September,1920.
<br />The Court finds that the said Bernhard Toben died, seized as the owner in fee simple of the folloi
<br />ing described real estate situated in the County of Hall, State of Nebraska, to -wit:
<br />The South half of the Northwest Quarter of Section Fourteen (14) in Township Nine (9) North of
<br />Range Ten (10) West of the 6'.P.M. in Hall County, Nebraska.
<br />The Northeast quarter of Section Fifteen (15) in Township Nine (9) North of Range Ten (10) West
<br />of the 6 P.M. in Hall County, Nebraska.
<br />The Southeast quarter of Section Fifteen (15) in Township Nine (9) North of Range Ten (10) West
<br />of the 6 P.M. in Hall County,Nebra,ska.
<br />That by the provisions of the last Will and Testament of the said Bernhard Toben, deceased, the
<br />following real estate to- wit;
<br />The South half of the Northwest quarter of Section Fourteen (14) and the Northeast quarter of
<br />Section Fifteen (15) all in Township Ten (10) North of Range Nine West of the 6 P.M. in said Hall
<br />County, Nebraska. ,
<br />did pass and descend, on the death of the said Bernhard .Toben, deceased, to Carl Toben, Henry Tot
<br />Mary Uden, Martha Toben and Anna Toben, share and share alike each to take an undivided one -fifth
<br />interest therein, subject to the life estate of Helen Toben, widow of said deceased.
<br />That by the provisions of the last Will and Testament of the said Bernhard Toben, deceased, the
<br />following described real estate, to wit:
<br />The Southeast quarter of Section Fifteen (15) in Township Ten (10) North of Range Nine (9) West
<br />of the 6 P.M. in Hall County, Nebraska,
<br />did pass and descend, on the death of the -said Bernhard Toben, deceased, to Carl Toben and Henry
<br />Toben, share and share alike, each to be the owner of an undivided one -half interest therein in
<br />fee simple and both to assume the indebtedness thereon.
<br />It is therefore considered by the Court that under the terms and provisions of the last Will and
<br />Testament of the said Bernhard Toben, deceased all of the above mentioned real estate did descend
<br />at his death in the manner following:
<br />The South half of the Northwest Quarter of Section Fourteen (14) and the Northeast quarter of
<br />Section Fifteen (15) all in Township Ten (10) North of Range Nine (9) West of the 6 P.M. in Hall
<br />County, Nebraska, to Carl Toben, Henry Toben, Mary Uden, Martha Toben and Anna Toben, share and
<br />share alike each to take an undivided one -fifth interest therein absolutely and all subject to
<br />the life estate of Helen Toben, mother of said above named and widow of said deceased.
<br />The Southeast Quarter of Section Fifteen (15) in Township Ten (10) North. -of Range Nine (9) West
<br />of the 6 P.M. in Hall County, Nebraska to Carl Toben and Henry Toben, share and share alike each
<br />to take an undivided one -half interest therein as tenant in common with the other, in fee simple
<br />subject to the indebtedness thereon.
<br />The Court further finds that the within estate is not subject to inheritance tax under the laws
<br />of the State of Nebraska. J.H.Mullin

<br />CEASED, with the original record thereof, now remaining in said Court, that the same is a oorr
<br />transcript thereof, and of the whole of such original record; that said Court is a Court of Re
<br />having a seal, which seal to hereto attached; that said Court has no Clerk authorized to sign
<br />tifioates in his own name, and that I am the legal custodian of said Seal and of -the Records of
<br />said Court, and that the foregoing attestation is in due form of law.
