<br />IN THE MATTER OF THE ESTATE )
<br />D E C R E E
<br />OF ROBERT E.BULGER, DECEASED. )
<br />Now on this 26th day of May, 193+, this cause came on for hearing upon the petition of John E.
<br />Bulger, praying for the settlement of said estate, for a determination of the heirship and right o:
<br />descent of the real estate belonging to Robert E.Bulger, and the degree of kinship of his heirs at
<br />law, and a decree settling his estate.
<br />And it appearing to the court from the proofs on file herein that due and legal notice has been
<br />given by publication for three successive weeks, as by law and the order of this court provided,
<br />all creditors, heirs at law and other persons interested in said estate, of the filing of said
<br />petition and of the time and place fixed for the hearing-of the same, and there being no objecti
<br />thereto, this case was duly submitted to the aDurt upon the petition and the evidence in support
<br />thereof, and the court being duly advised in the premises finds that the allegations in said
<br />petition are true, and that said petitioner, John E.Bulger, was the sole owner of an undivided
<br />seven•— eightba'.1fitarebt of the real estate hereinafter described, and is a competent and proper
<br />person to prosecute this proceeding, that the said Robert E.Bulger, died intestate in Deer Lodge
<br />County, Montana, on the 1st day of April, 1929) and at the time of his death, the said Robert E.
<br />Bulger was a resident and inhabitant of Deer Lodge County, Montana, and died seized as the owner
<br />in fee simple title of a one —ninth interest in and to the Northeast Quarter and the Southeast
<br />Quarter of the Southeast Quarter of section thirty —one (31), Township Ten (10) North of Range
<br />Eleven (11),Hall County, Nebraska, and that more than six years have elapsed since his death, and
<br />that no application has ever been made in the state of Nebraska, for the appointment of adminis-
<br />trator of his estate and no petition_ filed for that purpose, and no administration has ever been
<br />had upon the estate of Robert E.Bulger, deceased.
<br />The court further finds that the said Robert E.Bulger, left surviving him as his heir at law and
<br />only heir at law, his mother, Margaret E.Bulger.
<br />The court further finds that under the laws of the state of Nebraska, in f orce at the time of the
<br />date of the death .of the said Robert E.Bulger, the real estate hereinbefore described, passed and
<br />descended by absolute title to Margaret E.Bulger.
<br />The cour� that the funeral expenses of said deceased have been fully paid and that all debts
<br />of the deceased and of his estate, if any such existed, are forever barred and precluded, and that
<br />the costs of these proceedings have been paid.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by_the court that the said Robert E.Bulger died
<br />intestate in Deer Lodge County, Montana, on the lst day of April, 1928, that more than six years
<br />have elapsed between the date of the death of the said Robert E.Bulger and of the filing of the
<br />petition herein; that no application for the appointment of an administrator of his estate has
<br />ever been made, nor has there ever been any administration upon the estate of said deceased;in
<br />the state of Nebraska; that said deceased died seized as the owner in fee simple title of a
<br />one —ninth interest of the real estate hereinbefore described, situated in Hall County, Nebraska;
<br />that the petitioner is a competent and qualified person to prosecute this proceeding, that said
<br />deceased left surviving him as his heir at law and only heir at law, his mother, Margaret E.Bulger
<br />that upon the death of the said Robert E.Bulger, the real estate hereinbefore described descended
<br />in absolute title to Margaret E.Bulger.
<br />IT IS FURTHER ORDERED ADJUDGED AND DECREED by the court that all debts of said deceased, and of
<br />his estate, if any such there be, are forever barred and precluded and further administration of
<br />said estate is hereby dispensed with, and said estate is finally settled and forever closed.
