J <br />WILL AND DECREE RECORD <br />�xeeu�usxiN�co. $427 -5 -33 <br />a <br />I FINAL DECREE <br />In the Matter of the Estate <br />of <br />Edward O.Holmee, Deceased. <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />FINAL DECREE. <br />On this 5th day of June, 193+, this cause came on for hearing upon the final report of Lillian B. <br />Holmes, Administratrx of the estate of Edward O.Holmes, deceased, and upon her petition for <br />settlement of said estate and her discharge therein, <br />And the Court being fully advised in the premises and having examined the records and f ilea, find <br />that due and legal notice has been given to all persons interested in said estate of the time and <br />place fixed for the hearing upon said final report, as heretofore ordered by the Court, and no on <br />appearing to object to the final report, the Court examined the same, together with the vouchers <br />on file and testimony in support.thereof, and being fully advised in the premises, the Court fin <br />that said report is true and correct in all things and ought to be approved and allowed as and f <br />the final report of said administratiox. <br />The Court further finds that the said Edward O.Holmes departed this life on the 4th day of Fe <br />1932, and that at the time of his death the said Edward O.Holmes was a resident and inhabitant of <br />Hall County, Nebraska. <br />The Court further finds that on the 13th day of February, 1932; Lillian B.Holmes, widow, of <br />O.Holmes, filed in this Court her duly verified petition praying that letters of administration <br />may be granted to the said Lillian B.Holmes, widow of the deceased, in the estate of Edward 0. <br />Holmes, deceased; that the Court thereupon fixed the 9th day of March, 19321 as the date for hear, <br />ing upon said petition, and that due and legal notice of the filing of said petition and the time <br />and place fixed for hearing thereon was given by the Court in the manner provided by law, and that. <br />on the 9th day of March, 1932, a hearing was had and letters of administration issued to Lillian E. <br />Holmes, and she duly qualified as such administratiix. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for the presentation of claims against said estate; and that the time so <br />fixed by the Court has fully expired, and that all persons having claims agai rst said estate, if <br />any such there be, are forever barred and excluded from setting up or asserting any such claims <br />against said estate. <br />The Court further finds that there is no inheritance tax due the state of Nebraska upon the in- <br />heritance going to either the said Lillian B.Holmes or their adopted daughter, Geraldine Margaret <br />Holmes. <br />The Court further finds that the said Edward 0.Holmea,_,deceased, left surviving him as his heirs <br />and only heirs at law, the following named persons: Lillian B.Holmes, widow, and Geraldine Margare <br />Holmes, daughter, and that the said Geraldine Margaret Holmes was at the time of the death of the <br />said Edward O.Holmes, and still is, a minor. <br />The Court further finds that the said Edward O.Holmes, deceased, died seized in fee simple of the <br />following described real estate, to -wit: <br />Fractional Lot Nine (9) in Fractional Block Seven (7), in Wallich's Addition to the city df Grand <br />Island, and its complement, to -wit: Fractional Lot Nine (9) in Fractional Block Two (2)2 in Rollin <br />Addition to the city of Grand Island,Nebraska, as surveyed, platted and recorded. <br />That said property was the homestead of the deceased, and that under and by virtue of the laws of <br />descent of the state of Nebraska, said real estate passed and descended in equal shares to Lilli <br />B.Holmes and Geraldine Margaret Holmes in absolute title, subject, however, to a life estate go <br />to the said Lillian B.Holmes. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Lillian B. <br />Holmes, administratrix of the estate of Edward O.Holmes, deceased, be and the same hereby is in <br />I <br />its <br />
