52 WILL AND DECREE RECORD ..II }E AU6VSTIN EC O..$42M 3 FINAL DECREE In the Matter of the Estate of James_ Rauert, deceased. IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. DECREE OF DISTRIBUTION Now on this 29th day of May, 1934, this cause came on for hearing before the court upon the final account of George M.Rauert, the duly appointed administrator of the estate of James Rauert, de- ceased, who was otherwise known and described as Joachim Rauert, and upon the petition of the sai administrator for distribution of the assets remaining in his hands. The court being fully advis #d in the premises finds that due and legal notice of the said final account and petition for distri- bution has been given by publication, as required by the order of this court, to all persons interested in the said estate, and finds from examination of the said f inal account and upon con- sideration of the evidence introduced that the said final account is true and correct in all res- pects and should be approved. The court further finds that all proceedings have been had in the matter of the said estate for filing of claims; that the time and place for filing claims against said estate has been duly fi by order of court and due and proper notice thereon given to all creditors and other persons in- terested in said estate; that said time has expired; that all claims, debts, and demands against said estate, including the expense of administration, have been paid in full, and an order duly made barring any and all other claims; that proceedings have been had for the appraisement of sat estate for the determination of.Inheritance Taxes, if any due thereon, and an order has been ente ed finding that there is no Inheritance Tax due upon said estate, or any part thereof. The 'court fur Cher finds that the said administrator has on hands.belonging to said estate the sum of $2357.29 in cash, and holds a credit due from Nebraska National Bank of Grand Island, Nebraska, in the sum of $74.29, not collectable at the present time, and that the foregoing constitutes all of the per sonal property belonging to said estate. The court further finds that the said James Rauert died siezed of the following real estate, title to which upon the records of Hall County, Nebraska, is in the name of Joachim Rauert, to -wit; The West Half of the Southwest Quarter (Wj SWj) and the Southwest Quarter of the Northwest Quarte (SWJ W4) of Section 28, Township 12, North Range 10, Pest of the 6th P.M., Hall County, Nebraska The court further finds that the said James Rauert left as his sole and only heirs at law; William Rauert, a son, of Fruitland, Idaho, George M.Rauert, a son, of Cairo, Nebraska, and John Rauert, a son, of Ovina, Nebraska, and that the said real and personal property should be assigned and distributed to the said heirs at law in equal shares, and that upon distribution thereof the said administrator sh ould be dis- charged. IT IS THEREFORE CONSIDERED AND DECREED that the final account of the said administrator be, and t] same is hereby approved and confirmed; that the said administrator pay from the proceeds in his hands_to William.Rauert $785.77, to George M.Rauert $755.76, and to John Rauert $785.76. The sai credit due from the Nebraska National Bank is hereby assigned and distributed to the said heirs a- law in equal undivided shares, and the real estate hereinbefore described is hereby assigned and distributed to the said heirs at law in fee simple in equal undivided shares, and that upon pay- ment of the sums aforesaid to the persons entitled thereto the said George M.Rauert be and he is hereby discharged from his trust as administrator of said estate.
