T_MEAUGUSTINEM 8421-5 -33 .x-. <br />And the court further finds that said legacy of $2500.00 to Anna Huntzinger has been paid, and <br />that said estate, both real and personal, descends in four equal shares; that is to say, one char <br />to the children of Emma lothermel; one share to the children of Mrs. R.A.Clark, one share to the <br />i <br />children-of Mrs. William Headley, and one share to the children of William Huntznger. <br />The court further finds from the evidence and the proof submitted that Emma Rothermel left sur- <br />viving her the following named hefts: Mrs. Carrie Clarke, William S.Rothermel, Mrs.Nellie Erney, <br />Mrs. Mae Williams, Mrs. Jean Patrick, Mrs.Martha Thomas,_Mr.Harry Rupp and Mrs.Dorothy Holdren. <br />{ <br />It appears from the proof submitted that Mrs. Nellie Erney, Mrs. - N&e Williams, Mrs. Jean Patrick, <br />' Mrs. Martha Thomas, ,Mr.Harry_Rupp and Mrs. Dorothy Holdren are children of Mrs.Albert Rupp, who <br />was a daughter of Emma Rotthermel, deceased, and that Mrs. Albert Rupp is now deceased and left <br />Esurviving no husband. The court finds that the respective share of the heirs of Mrs. Emma Rother <br />mel in the estate is as follows: <br />Mrs. <br />Carrie Clarke- - - <br />- - -1/12 <br />William S.Rothermel- - - <br />- - 1/12 <br />Mrs. <br />Nellie Erney - - - <br />- - 1/72 <br />Mrs. <br />Mae Williams - - - <br />- - -1/72 <br />Mrs. <br />Jean Patrick - - - <br />- - -1/72 <br />Mrs. <br />Martha Thomas - - - <br />- - 1/72 <br />Mr.Harry Rupp - - - - - <br />- - 1/72 <br />Mrs. <br />Dorothy Holdren - - <br />- - 1/72 <br />The court further finds from the proof of heirship submitted that Mrs. William Headley named in <br />the Will is now deceased and that her husband is also deceased, and that she left as her heir at <br />law and only heir at law) a son, Charles N.Headley, I find, therefore, that the interest of said <br />heir in said estate is as follows: <br />Charles N.Headley - - - - - 1/4 <br />The Court .further finds from the proof submitted that Mrs. ]Robert A.Clark was a sister of Mary S. <br />Wells, deceased; that she is dead and that her husband is also dead, and that she left_as her <br />heirs at law her two children as follows: Mrs. Frank Turner and Mrs. A.M. Sides, and the court <br />finds that said heirs take jointly an undivided one- fourth interest in said estate and their <br />respective interest are as follows: <br />Mrs. Frank Turner - - - - - - 1/8 <br />Mrs. A.MSides - - - - - - - - 1/8 <br />The court further finds from the evidence that William Huntzinger is deceased and that his wife <br />is-dead; and that he left surviving him the following children: Mrs. Marjorie Hudson, Mrs. Annie <br />Schlegle, Fred Huntzinger, Arthur Huntzinger and Louis Huntzinger. It appears from the evidence <br />that Louis Huntzinger is deceased, and there is no evidence showing whether or not he left any <br />Child or children surviving him. The court, therefore, finds that the interests of the respeeti <br />parties in the estate of Mary S.Wells to be as follows: <br />Mrs. Marjorie Hudson - - - -1/20 <br />Mrs. Annie Schlegle - - - - - -1/20 <br />Fred Huntzinger - - - - - - - -1/20 <br />Arthur Huntzinger - - - -1/20 <br />Louis Huntzinger, or his heirs in the event he <br />is now deceased and has no heirs surviving <br />him -+ - - - - - - - - - - - - -1 /20 <br />The court further finds that in the event Louis Huntzinger is deceased and left no children sur- <br />viving him, then his 1/20 interest would be inherited by the other four children, his brothers <br />i <br />and sisters. <br />The Court further finds from the evidence introduced that the heirs of Mary S.Wells have asked <br />the firm of Prince & Prince to act as their Agent in the future handling of the property until <br />other arrangements can be made, and the court finds that said W.A.Prince, as Executor, has by j <br />I <br />virtue of said arrangement lawful authority to assign and transfer to the firm of Prince & Prince <br />as Agent for the heirs of Mary S.Wells, deceased, the residue of the personal property of said <br />estate and to take charge of the real estate. <br />r <br />
