<br />no application for the appointment of an administrator of this estate has ever been made,�nor has
<br />there ever been any administration upon the estate of said deceased in the State of Nebraska; tha
<br />said deceased died seized as the owner in fee simple title of the real estate hereinbefore des-
<br />cribed, situated in Hall County, Nebraska; that the petitioner is a competent and qualified perso
<br />to prosecute this proceeding;; that said deceased left surviving her as her heirs at law and her
<br />only heirs at law, the following:

<br />that upon the death of the said Sarah Bowker, the real estate hereinbef ore described descended in
<br />absolute title to John H.Pedley one - fourth thereof, to Charles D.Bowker one - fourth thereof, to
<br />Mary E.Glover one - fourth thereof, and to Sarah Jane Cole one - fourth- thereof.
<br />IT IS FURTHER_ ORDERED, ADJUDGED AND DECREED by the Court that all debts of said deceased, and of
<br />his estate, if any such there be, are forever barred and precluded and further administration of
<br />said estate is hereby dispensed with, and said estate is finally settled and forever closed.

<br />I, Mary S.Wells, of Center Precinct, Hall County and State of Nebraska, being of sound and dis-
<br />posing mind but not unmindful of the possibilities of death, do make, declare,and publish this,
<br />my last will and testament, hereby revoking any and all former wills by me made, and solemnly
<br />declare this to be my last will and testament.
<br />lot.. In the event of my death I direct that all my just debts and funeral expenses shall be
<br />first paid out of my estate.
<br />2nd. I give, devise and bequeath unto my niece, formerly Miss Anna Huntzinger, daughter of my
<br />deceased brother Allen Huntzinger, the sum of Two- thousand, Five - hundred Dollars, ($2500.00) and
<br />in the event of her death I direct that this legacy shall not lapse but that it descend to her
<br />children in equal shares, and I make this legacy a first charge upon my estate.
<br />3rd. i give, devise and bequeath all the rest and residue of my estate, both real and personal,
<br />of every kind and nature whatsoever and whereever situated in equal shares to my brother and
<br />sisters, that is to say in equal shares to my beloved sister, Emma Rotherman of Gerard College
<br />Philadelphia, to Mrs. R.A.Clark of New York City, Mrs. William Headley now residing at 1118 East
