<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.
<br />IIN THE MATTER OF THE ESTATE OF ) D E C R E E
<br />SIRAH ELLEN HOUSER: DECEASED.
<br />Now on this 30th day of January, 1933, this cause came on for hearing upon the petition of Minnie
<br />M.Houser, praying for the settlement of said estate, for a determination of the heirship and right
<br />of. descent of the real estate belonging �o Sarah Ellen Houser, and the degree of kinship of her
<br />heirs at law, and a decree settling her estate,
<br />And it appearing to the aourt from the proofs on file herein, that due and legal notice has been
<br />given by publication for three successive weeks, as by law and the order of this court provided,
<br />to all creditors, heirs at law and other persons interested in said estate, of the filing of said
<br />petition and of the time and place fixed for the hearing of the same, which time was not less than
<br />three weeks nor more than 60 days after the filing of said petition, and there being no objections
<br />thereto, this cause was duly submitted to the court upon the petition and the evidence in support
<br />thereof, and the ®urt being duly advised in the premises finds that the allegations in said peti-
<br />tion are true, and that said petitioner, Minnie M.Houser is the present owner of the real estate
<br />hereinafter described and is a competent and proper person to prosecute this proceeding, that the
<br />said Sarah Ellen Houser died intestate in Hall County, Nebraska on the lst day of December, 1929,
<br />and at the time of her death, the said Sarah Ellen Houser was a resident and inhabitant of Hall
<br />County: Nebraska, and died seized as the owner in fee simple of a one -fifth interest in and to the

<br />following ^real estate:
<br />The Northeast Quarter (N*) of Section Thirty -four 34), the West Seventy -eight (79) rods of
<br />Northwest Quarter of the Northeast Quarter (NWJ NEJ §, the North Half of the Northwest Quarter
<br />�Nj NW ) of Section Thirty -five (35) in Township Eleven (11) North, Range Ten (10) West of the
<br />th Principal Meridian;
<br />that more than five years have elapsed since her death, and that no application has ever;,been made
<br />in the state of Nebraska for the appointment of administrator of her estate and no petition filed
<br />for that purpose, and no administration has ever been had upon the estate of Sarah Ellen Houser,
<br />deceased.
<br />The court further finds that the said Sarah Ellen Houser left surviving her as her heirs at law
<br />only heirs at law, the following named persons, to -wit:
<br />Alice E.Houser, a daughter,
<br />Sarah J.O'Bryan, a daughter,
<br />Minnie M.Houser, a daughter,
<br />and Charles N.Houser, a, son,
<br />all of whom are of legal age.
<br />The court further finds that under the laws of the State of Nebraska, in force at the time of the
<br />date of the death of the said Sarah Ellen Houser, the real estate hereinbefore described, passed
<br />and descended by absolute title to Alice E.Houser, one - fourth thereof, Sarah J.0'Bryan, one - fourth
