rm NJ � � 1 �?') 1. 1. , MkI Im A X THE pUGUSTINEC0.8427 -5 -33 - petition and of the time and place fixed for the hearing of the same, which time was not less than1 thirty days nor more than 60 days after the filing of said petition, and there being no objections thereto, this cause was duly submitted to the court upon the petition and the evidence in support thereof, and the oourt being duly advised in the premises finds that the allegations in said petit are true, and that said petitioner, John Kohnk is the present owner of the real estate hereinafter described, and is a competent and proper person to prosecute this proceeding, that the said Horace C.Wood died intestate in Kane County, Illinois on the 28th day of June, 1985, and at the time of his death, the said Horace C.Wood was a resident and inhabitant of Kane County, Illinois, and died seized as the owner in fee simple of the North Half of the Northwest Quarter (Nf- NWJ) of Section ten Nineteen (19) Township Eleven (11) North, of Range Twelve (12), Nest of the 6th P.M. in Hall Count) Nebraska, and that more than two years have elapsed since his death, and that no application has ever been made in the state of Nebraska for the appointment of administrator of his estate and no petition filed for that purpose, and no administration has ever been had upon the estate of Horac C.Wood, deceased. The Court further finds that the said Horace C.Wood left surviving him as his heirs at law and on] heirs at law, the following named persons, to -wit: Zlecta C.Wood, his widow, William B.Wood, Mary Wood Ruth and Delbert C.Wood, his children, all of whom are of legal age. The court further finds that under the laws of the State of Nebraska, in force at the time of the date of the death of the said Horace C.Wood, the real estate hereinbefore described, passed and descended by absolute title to Electa C.Wood, one -third thereof, and that the remaining two- thirds passed and descended in equal shares to William B.Wood, Mary Wood Ruth and Delbert C.Wood, children -of the said Horace C.Wood, in equal shares to each. The court further finds that the funeral expenses of said deceased have been fully paid and that all debts of the deceased, and of his estate, if any such existed, are forever barred and precludE and that the costs of these proceedings have been paid. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the court that the said Horace C.Wood died inte Late in Kane County, Illinois on the 25th day of June, 18952 that more than two years have elapse between the death of the said Horace C.Wood and of the f iling of the petition herein; that no application for the appointment of an administrator of his estate has ever been made, nor has there ever been any administration upon the estate of said deceased in the state of Nebraska; tha d, said deceased died seized as the owner in fee simple title of the real estate hereinbefore desori ed, situated in Hall County, Nebraska; that the petitioner is a competent and qualified person to prosecute this proceeding, that said deceased left surviving him as his heirs at law, shd his only, heirs at law, the following: Eleota C.Wood, William B.Wood, Mary Wood Ruth and Delbert C.Wood, that upon the death of the said Horace C.Wood, the real estate hereinbefore described descended i absolute title to Electa C.Wood, one -third thereof, and the remaining two- thirds to William B.Wor., Mary Wood Ruth and Delbert C.Wood, in equal shares to each. IT IS FURTHER ORDERED ADJUDGED AND DECREED by the court that all debts of said deceased, and of his estate, if any such there be, are forever barred and precluded and further administration of said estate is hereby dispensed with, and said estate is finally settled and forever closed.
