<br />petition and of the time and place fixed for the hearing of the same, which time was not less than1
<br />thirty days nor more than 60 days after the filing of said petition, and there being no objections
<br />thereto, this cause was duly submitted to the court upon the petition and the evidence in support
<br />thereof, and the oourt being duly advised in the premises finds that the allegations in said petit
<br />are true, and that said petitioner, John Kohnk is the present owner of the real estate hereinafter
<br />described, and is a competent and proper person to prosecute this proceeding, that the said Horace
<br />C.Wood died intestate in Kane County, Illinois on the 28th day of June, 1985, and at the time of
<br />his death, the said Horace C.Wood was a resident and inhabitant of Kane County, Illinois, and died
<br />seized as the owner in fee simple of the North Half of the Northwest Quarter (Nf- NWJ) of Section
<br />ten
<br />Nineteen (19) Township Eleven (11) North, of Range Twelve (12), Nest of the 6th P.M. in Hall Count)
<br />Nebraska, and that more than two years have elapsed since his death, and that no application has
<br />ever been made in the state of Nebraska for the appointment of administrator of his estate and no
<br />petition filed for that purpose, and no administration has ever been had upon the estate of Horac
<br />C.Wood, deceased.
<br />The Court further finds that the said Horace C.Wood left surviving him as his heirs at law and on]
<br />heirs at law, the following named persons, to -wit:
<br />Zlecta C.Wood, his widow,
<br />William B.Wood,
<br />Mary Wood Ruth and
<br />Delbert C.Wood, his children,
<br />all of whom are of legal age.
<br />The court further finds that under the laws of the State of Nebraska, in force at the time of
<br />the date of the death of the said Horace C.Wood, the real estate hereinbefore described, passed
<br />and descended by absolute title to Electa C.Wood, one -third thereof, and that the remaining two-
<br />thirds passed and descended in equal shares to William B.Wood, Mary Wood Ruth and Delbert C.Wood,
<br />children -of the said Horace C.Wood, in equal shares to each.
<br />The court further finds that the funeral expenses of said deceased have been fully paid and that
<br />all debts of the deceased, and of his estate, if any such existed, are forever barred and precludE
<br />and that the costs of these proceedings have been paid.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the court that the said Horace C.Wood died inte
<br />Late in Kane County, Illinois on the 25th day of June, 18952 that more than two years have elapse
<br />between the death of the said Horace C.Wood and of the f iling of the petition herein; that no
<br />application for the appointment of an administrator of his estate has ever been made, nor has
<br />there ever been any administration upon the estate of said deceased in the state of Nebraska; tha
<br />d,
<br />said deceased died seized as the owner in fee simple title of the real estate hereinbefore desori ed,
<br />situated in Hall County, Nebraska; that the petitioner is a competent and qualified person to
<br />prosecute this proceeding, that said deceased left surviving him as his heirs at law, shd his only,
<br />heirs at law, the following:
<br />Eleota C.Wood,
<br />William B.Wood,
<br />Mary Wood Ruth and
<br />Delbert C.Wood,
<br />that upon the death of the said Horace C.Wood, the real estate hereinbefore described descended i
<br />absolute title to Electa C.Wood, one -third thereof, and the remaining two- thirds to William B.Wor.,
<br />Mary Wood Ruth and Delbert C.Wood, in equal shares to each.
<br />IT IS FURTHER ORDERED ADJUDGED AND DECREED by the court that all debts of said deceased, and of
<br />his estate, if any such there be, are forever barred and precluded and further administration of
<br />said estate is hereby dispensed with, and said estate is finally settled and forever closed.
