<br />the two children of said Edna G.Holmes, namely, Paul Holmes, and Christine Holmes, and to the 
<br />survivor of them) to Genevieve R.Tobey, in the event she survives said Edgar S.Leavenworth, fiv 
<br />shares of said stock, and in the event of the death of the said Cora L.Holmes, Robert E.Green- 
<br />leaf, and Genevieve R.Tobey, or either of them, prior to the death of the said Edgar S.Leaven- 
<br />rth, then the shares of stock in said State Bank of Clarks bequeathed to the said Cora L. 
<br />olmes, Robert E.Greenleaf, and Genevieve R.Tobey, become the absolute property of the said 
<br />S.Leavenworth, under the terms and provisions of the residuary clause of the last will 
<br />test4ment of said deceased. 
<br />e court further finds that the said Emma E.Leavenworth died seized as. the owner in fee simple 
<br />f the following described real estate situated in the county of Hall and State of Nebraska, 
<br />The west half of the northeast quarter of the southeast .quay ter of section Nineteen (19), in 
<br />Township Ten (10), North, Range Eleven (11) West, in`Ha11 County, Nebraska, excepting that por- 
<br />tion sold to the Wood River Trotting Association, by deed dated Allril 6, 1593; also the certain 
<br />tract described as follows: Commencing at a point at a stone set in the line between the north- 
<br />east quarter of the southeast quarter and the northwest quarter of the southeast quarter of 
<br />Section 19, Township 10, North, Range 11 West, said stone being 660.feet north of the southeast 
<br />corner of the northwest quarter of the southeast quarter of said Section 19; and running thence 
<br />north, 55 degrees west, variation 11 degrees and 56 minutes east, 709 feet, to a stake where sa 
<br />line intersects the bounds of the Union Pacific Railway Company's grounds; thence following the 
<br />same, 70 degrees and 21 minutes east, variation 11 degrees, 56 minutes, east, 761-1/2 feet, to a 
<br />stake and concrete placed in line of'east side of northwest quarter of the southeast quarter, a 
<br />running thence south 1 degree and 20 minutes west, variation 11 degrees and 56 minutes east, 
<br />255 feet to the place of beginning, and containing 2.35 acres, a little more or less, and that 
<br />under the terms and provisions of the last will and testament of the said Emma E.Leavenworth, 
<br />said real estate becomes the absolute property of the said Edgar S.Leavenworth. 
<br />e court further finds that at the time of her death the said Emma E.Leavenworth was the owner 
<br />f 17 shares of the capital stock of the First National Bank of Wood River, Nebraska, and that 
<br />the terms and provisions of the last will and testament of the said Emma E.Leavenworth, 
<br />deceased, said shares of stock become the absolute property of the said Edgar S.Leavenworth. 
<br />IT IS, THEREFORE, ORDER9D2 _ADJUDGED; AND DECREED BY THE COURT that the final report of the said 
<br />Edgar S.Leavenworth, as Executor of the last will and testament of Emma E.Leavenworth, be and

<br />the same hereby is allowed and approved as and for the final report of said Executor, said estate 
<br />is closed, and said Executor discharged. 
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims against 
<br />the estate; of the said Emma E.Leavenworth, deceased, if any such there be, are forever barred as 
<br />enjoined from setting up or asserting any such claims against said estate. 
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that under the terms and provisions ofj 
<br />the last will and testament of the said Emma E.Leavenworth, deceased, the real estate herein-

<br />before described passed and descended, by absolute title, to the said Edgar S. Leavenworth. 
<br />IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that Edgar S.Leavenworth becomes the owner, during

<br />his lifetime, of fourteen shares of the capital stock of the State Bank of Clarks, owned by 
<br />said deceased at her death; that upon the death of the said Edgar S.Leavenworth, the remainder 
<br />in one share of said stock becomes the property of Cora L.Holmes, in the event she survives the,

<br />said Edgar S.Leavenworth, and that upon the death of the said Edgar S. Leavenworth, the remainder 
<br />in six shares of said stock becomes the property of Edna G.Holmes, in the event she survives 
<br />said Edgar S.Leaver_worth, and in the event she does not survive the said Edgar S.Leavenworth, 
<br />then the remainder in said six shares of the capital stock of said bank becomes the property of 
<br />Paul Holmes and Christine Holmes, or the survivor of them, and that upon the death of the said 
<br />Edgar $- Leavenworth) Robert E.Greenleaf becomes the owner of the remainder of two shares of th 
<br />capital stock of said bank, in the event he survives the said Edgar S.Leavenworth, and that upo 
<br />the death of the said Edgar S.Leavenworth, Genevieve R.Tobey becomes the owner of the remainder 
<br />of five of said shares of the capital stock of said Bank, and in the event the said Cora L.Holm s, 
<br />Robert E.Greenleaf, or Genevieve R.Tobey, should die before the death of the said Edgar S.Leave'-
