I L1�1 � � 1 r �M �� �J <br />64 of the deed records of said Hall County; <br />;`deed, recorded in book 39, page 5 - <br />Lot numbered six (6) in block numbered nineteen (19) in the Original Town, now city of Grand <br />'Island, Hall County, Nebraska, as surveyed, platted and recorded. <br />Lot number eight (�) in block number six (6) in the Original Town, now city of Grand Island, <br />Hall County, Nebraska. <br />The Court further finds that the said August Moeller was the owner of personal property, con - <br />sisting of an undivided one -half interest in and to a certain real estate mortgage executed by' <br />Hans Guelzow,Jr. and wife, dated March 1, 1932, in the sum of Fifty -five Hundred ($5500.00) <br />Dollars, due March 1, 1937, drawing interest at five and one -half per cent per annum, payable <br />:semi- annually, which mortgage is recorded in book 35 of mortgages at page 199 of the mortgage <br />records of Howard County, Nebraska and which mortgage is a first mortgage on the following des - <br />cribed real estate, to -wit: <br />The Nest half of the Southwest Quarter (W-g' SWJ), the Southeast Quarter of the Southwest Quartet <br />(SEJ SWJ) of Section eight (S) in Township Thirteen (13) North, of Range Nine (9), subject to <br />the right of way of the 0&RV railroad Company. <br />.The Court further finds that the said August Moeller and the executrix herein Auguste Moeller, <br />were the owners of a joint mortgage executed by John Reher and wife in the sum of Five Thousand <br />($5000.00) Dollars, dated January 31, 1930, due January 1, 1935; drawing interest at the rate of <br />.five and one -half per cent, interest, recorded in book 56 of mortgages at page 690 of the mortgage <br />records of Hall County, Nebraska, which mortgage covered the West Half of the Northeast Quartet <br />(W-ffI NEJ) of Section Twenty -four (24) Township Twelve (12) North, of Range Ten (10) in Hall County, <br />Nebraska, and said mortgage was payable as follows: "To August Moeller and Auguste Moeller and, <br />the survivor of them," and the Court finds that said last above described mortgage became the <br />sole property of the said Auguste Moeller upon the death of the said August Moeller, and that <br />the said Auguste Moeller is authorized and empowered to release said mortgage or to make an <br />assignment thereof and that the proceeds of said mortgage, not being any part of the estate of <br />,;August Moeller, need not be accounted for by the executrix, Auguste Moeller and that the said <br />mortgage became her sole property upon the death of the said August Moeller. <br />The Court further finds that under and by virtue of the provisions of said last will and testa <br />merit, all of the above described real estate, and all of the interest, right, OR TITLE which <br />i <br />the said August Moeller had in the above described mortgages, passed and descended at the deatt <br />of the said August Moeller, in absolute title, to Auguste Moeller, his wife• <br />i <br />The Court further finds that the said Auguste Moeller has paid certain claims against said <br />estate which were not filed in this court, out of her own separate funds but that she is the <br />sole legatee under the said will, and the Court further finds that in her report filed herein, <br />she waives any claim which she might have for having paid said claims out of her own funds, l <br />and that the above property passed and descended to her as above set forth, free of liens, <br />claims and encumbrances except such as may be recorded in the office of the Register of Deeds <br />of Hall County, Nebraska. �! <br />IT IS THEREFORE, CONSIDERED, ADJUDGED AND DECREED by the Court that all right, title and inter', <br />est_of the said August Moeller in and to the <br />Fractional Lot Two (2) in Block One (1) of Russel Wheeler's Addition to the city of Grand Isla�d, <br />Nebraska, and its complement, to- wit: Fractional Lot Two (2) in Block One Hundred Twenty -six <br />(126) of the Union Pacific Railway Company's Second Addition to Grand Island,Nebraska, as sur- <br />veyed, platted and recorded, and being the same premises conveyed to Hamilton L.Birney by war- <br />ranty deed and recorded in book 39,page 399 and by him and wife to G.W.Weeter by warranty deed' <br />recorded in book 39,page 542, and by the latter and wife to said Louise Anna Loan by warranty (; <br />deed, recorded in book 39, page 564 of the deed records of said Hall County; j+ <br />Lot numbered six (6) in block numbered nineteen (19) in the original town, now city of Grand <br />Island, Hall County, Nebraska, as surveyed, platted and recorded; <br />i <br />Lot number eight (8) in block number six (6) in the original town, now city of Grand Island, <br />Hall County, Nebraska, <br />and in and to the mortgages above described, did pass and descend at the death of the said <br />IE <br />i f <br />
