LINCOLN NEB the death of my said wife, leaving no children or husband, then this devise shall lapse, and and the said real estate shall pass to the devisees and be governed by the provisions set forth and described in Paragraph Sixth of this Will. SIXTH. I give, devise and bequeath unto my nine Nephews and Nieces hereinafter named, subject to the life estate therein of my said wif e, Nellie Quigle, the Northeast Quarter of Section Twenty, -four, Township Nine, North, Range Nine, West of the 6th P.M. in Hall County, Nebraska, to be divided among them, share and share alike, in the following manner, to -wit: I hereby authorize and direct the Probate Court which shall have jurisdiction over this my last Will and Testament.to upon the death of my said wife Nellie Quigle, appoint a suitable person as Trustee or Administrator de bonis non, for the purpose of selling and conveying the said described land, and such other of my said lands as may through the events hereinbefore described come under the provisions of this paragraph, and of distributing the proceeds thereof among tho persons entitled thereto as in this paragraph set forth; and I hereby expressly authorize and empower such Trustee or Administrator de bonis non to sell and convey the said lands and each and every part thereof, either at public or private sale, as shall be deerned for the best in-, terests of my estate, without the intervention of any other Court than said Probate Court havitg jurisdiction of this Will; and I direct that such Trustee or Administrator de bonis non shall be placed under such Bond as shall be fixed by the court. The names of said nine Nephews and Nieces are as follows: 011ie Sheaff Mangles, of Fullerton, Nebraska; George Sheaff of Fullerton, Nebraska, Frank Sheaff of Fullerton, Nebraska; Artie E.Sheaff of Fullerton, Nebraska; Ada Mitchelmore of Hastings, Nebraska; John Quigle of Lincoln, Nebraska; Perian Kreider of Doniphan, Nebraska; Ross Hagaman of Trumbull, Nebraska, Rosa Haggard of Trumbull, Nebraska; said land to be sold within two (2) years after the death of my said wife, and conveyed in said period. Provided, however, that in the event of the death of either or any of the said nephews and nieces named in this paragraph, leaving no surviving spouse or children, then the share or shares of such deceased person or persons shall lapse, and be distributed to the others of said nephews and nieces herein named, share and share alike. In explanation of my reason for giving my said wife a life estate in my said farm lands. I wi to be assured of an axflple income for her during her lifetime in the event of the dissipation or necessity of expending the personal property herein bequeathed to her. It is my further direction that my said wife pay the taxes on the land and keep the premises a reasonable condition, inevitable loss, wear and tear, excepted, during her lifetime. It is hereby further directed that the Attorney or Attorneys appointed to conduct the admini tration of the Will and my estate shall receive as compensation therefor a sum of not to exceed Two hundred and fifty Dollars. I hereby nominate as Executrix of this my last Will and Testament my dearly beloved wife Nellie Quigle, and request that she be not required to furnish bond therefor.
