<br />On this 18th day of March, 1933, this matter came on to be heard upon the petition for final
<br />settlement, and the evidence, and was submitted to the court, upon consideration whereof the
<br />court finds: j
<br />That this is the time and place fixed and designated by the order of the court for the final it
<br />hearing of this matter, and that notice thereof has been given as provided and required by lawli
<br />and the order of this court, and that this matter should now be heard and finally determined.
<br />That Lewis Quigle died on the 14th day of September, 1932, a resident of Adams County, Nebrask ,
<br />and he left a last will and testament which has been duly probated herein, and the will of thel
<br />deceased, together with certificate of probate is as follows, to —wit: j
<br />WILL
<br />I, Lewis Quigle, of Hastings, Nebraska; being of sound mind and memory do make, ordain, publi
<br />and declare this to be my last Will and Testament, hereby revoking all former Wills by me made
<br />FIRST, I order and direct my Executrix hereinafter named, to pay all my just debts, funeral
<br />expenses and expenses of administering my estate as soon after my decease as conveniently may
<br />SECOND, After the payment of such debts and expenses, I give, devise and bequeath unto my be-
<br />loved wife, Nellie Quigle, my entire personal estate consisting principally of monies, notes a
<br />mortgages, and also, for the term of her natural life, the use, income, rentals, and control o
<br />all my real estate wherever the same may be situated, of which I may die seized and possessed.
<br />I also give, devise and bequeath unto her my res id.ence prop er ty where we shall reside at the
<br />time of my decease, to be hers absolutely.
<br />THIRD, I give, devise and bequeath unto my nephew, Lewis Quigle, subject to the life estate
<br />therein of my wife, Nellie Quigle, the North Half of the North Half of the Northeast Quarter o
<br />Section Seventeen, Township Nine, North, Range Nine, ?hest of the 6th P.M. in Hall County,
<br />Nebraska, to be his absolutely, provided, however, that if the said Lewis Quigle should die
<br />prior to the death of my said wife, leaving no wife or children, then this devise shall lapse,
<br />and the said real estate shall pass to the devisees and be governed by the ?provisions set fort
<br />and described in Paragraph Sixth of this Will.
<br />FOURTH, I give, devise and bequeath unto my nephew Henry Quigle, subject to the life estate
<br />therein of my wife Nellie Quigle, the South Half of the North Half of the Northeast Quarter of
<br />Section Seventeen, Township Nine, North, Range Nine, Ilest of the 6th P.M., in Hall County,
<br />Nebraska, to be his absolutely, provided, however, that if the said Henry Quigle, should die
<br />prior to the death of my said wife, leaving no wife or children, then this devise is to lapse
<br />and the said real estate shall pass to the devisees and be governed by the provisions set fort:

<br />FIFTH. I give, devise and bequeath unto Marie Ehlers whose residenbe is Dresden, Kansas, subje
<br />e.
<br />to the life estate therein of my said wife, Nellie Quigle, the West Half of the Northwest Quarter
<br />of Section Sixteen, Township Nine, North, Range Nine, West of the 6th P.M., in Hall County,
<br />Nebraska, provided, however, that in the event of the death of the said Marie Ehler, prior to
