IN THE COUNTY COURT OF SAID COUNTY: ADAMS COUNTY, E At a Session of the County Court held in and for said County, at the County Court Room, in the, City of Hastings, County of Adams, and State of Nebraska. Present: W.HALSEY BOHLKE, Judge of the County Court. IN THE MATTER OF THE ESTATE OF ) FINAL DECREE AND ASSIGNMENT GEORGE B.LOUCKS, deceased ) OF ESTATE. Now, on this 20th day of February, 1933, this matter comes on for hearing upon the petition of''. Homer Loucks, administrator with will annexed of the estate of George B.Loucks, deceased, filed in this court on the 3rd day of February, 19332 praying for the allowance of his final report filed, the assignment of the residue of said estate,and for his discharge from said trust. The court finds that due notice has been given by publication, as provided by law, of the time and place of this hearing, and that all of the interested parties are in court, and that the court has jurisdiction of all of the interested parties and of the subject matter hereof. In consideration of the evidence, and of the records and files herein, the court finds; That George B.Loucks, departed this life testate, on the 8th day of August, 1932, a reside#6t of Adams County, Nebraska; that said deceased left surviving him as his sole heirs at law, nexi of kin, devisees and the only persons interested in his estate, Elmer Loucks, a son, Homer Loucks, a son, and Carrie L.Loucks, daughter -in -law, all of whom are of legal age; that said deceased left no widow, nor any other son or daughter, nor any child or children of any deceaso child him surviving. That on the 12th day of August, 1932, Elmer Loucks, one of the sons of said deceased, filed in this court his petition asking that a certain instrument which he alleged to be the last will 'and testament of said deceased, be allowed and probated; that due notice of the time and place of hearing on said petition was given by publication as provided by law, and on the 20th day o� September, 1932, this court made and entered an order, finding and allowing said instrument as! I the last will and testament of said deceased; that a copy of said last will and testament, to -, gether with certificate of probate thereof, is attached hereto and made a part hereof. E That on said 20th day of September, 1932, this court made and entered an order appointing I Homer Loucks as the administrator, with will annexed of said will and estate; that on said dato he qualified as such and has been acting in that capacity since. The court further finds that due notice was given to creditors to file claims against said estate; that no claims were filed, and that all claims not filed have been forever barred; that as shown by the final report of said administrator with will annexed, filed in this court on ;February 3, 1933, all of the debts of said deceased, including the expense of his last sick - ness and burial, and the costs of administering his estate, have been fully paid, and as shownG, by said report, there remains on hand $2537.35, to be distributed as cash. i That said administrator has only partially reduced the personal property, as described in the inventory,-to cash; that he has accounted for the cash on hand, as shown in the inventory 4594-87, also the mortgage given by Dennis Mullen, the authmobile and the household goods; that all of the balance of the personal property remains intact, and by arrangement and agree-!,,, ,ment of the interested parties, is to be assigned to the parties entitled thereto under the will of said deceased, as provided therein. i E' That said deceased died seized and in possession of the following described real estate,to -with !E East 120 acres of Southeast Quarter of Section 34, township 9, north, range 93 west 6th P.M. f in Hall County, Nebraska r Northwest Quarter of Section 4, township S, north,range 9, West 6th P.M. in Adams Countv,Nebr��
