�uLLr�'im <br />!as executor, was duly appointed and Letters Testamentary issued to him upon his filing a bond <br />as required by law. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for filing claims against said estate, and that all persons having <br />claims against said estate not filed within the time fixed by the Court, if any such there be, <br />are forever barred, excluded and enjoined from setting up or asserting any such claims against, <br />said estate. <br />The Court further finds that said deceased departed this life leaving as his hers at law, ind <br />only heirs at law, and persons entitled to shax a in said estate, the following named persons, <br />to -wit: <br />.Caroline Vieregg, surviving widow <br />Malvina Roeser, a daughter <br />Louise Lorentzen, a daughter <br />Ottilie Vieregg, a daughter <br />Emil H.Vieregg, a son, <br />Henrietta Vieregg, a daughter, <br />Oscar A.Vieregg, a son, <br />Elsie Vieregg, a daughter, <br />';Henry F.Vieregg, a son, <br />John Vieregg, a grandson, age 271 <br />Robert Vieregg, a grandson, age 25 years <br />Frederick Vieregg, a grandson, age 18 years, <br />Alice Vieregg, a grand- da�ghter`,.age 16,years <br />Frances Vieregg, a grand - daughter, age 14 years, <br />Elsie Vieregg, a grand - daughter, age 12 years, <br />Pauline Vieregg, a grand - daughter, age 22 years <br />The Court further finds that the said deceased died, the owner of real estate situated in <br />Hall County, Nebraska, to -wit: Lots Five and Six (5) and (6) in Block Eighty (80) in the <br />Original town, now city of Grand Island,Nebraska, which property did pass and descend by virtue <br />of the terms and provisions of said will, at the death of the deceased Henry Vieregg, to <br />wife for and during her natural lifetime, and that upon her death;;, <br />Caroline Vieregg, surviving , g <br />Lot Five in Block 80 in the Original town now city of Grand Island,Nebraska, above described,'; <br />did pass and descend as follows, to- wit: The Northerly 22 feet of said Lot 5 in Block 80 of f <br />the Original town of Grand Island, to Ottilie Vieregg; the Southerly 22 feet of the Northerly;, <br />44 feet of said Lot 5, to Henry F.Vieregg; the Southerly 22 feet of the Northerly 66 feet of <br />Lot 5 above described to Elsie Vieregg and Henrietta Vieregg in equal shares to each. The '! <br />South half of Lot Five above described, did pass and descend to Ottilie Vieregg, Henrietta <br />Vieregg and Elsie Vieregg in equal shares to each. <br />The Court further finds that under the third paragraph of the Last.Will and Testament of Henry <br />Vieregg, deceased, the executor therein named, Emil H.Vieregg, was authorized and empowered to <br />convey Lot Six (6) in Block Eighty (80) in the Original town now city of Grand Is land ,Nebrask�;, <br />i <br />and to divide the proceeds thereof as follows: <br />I <br />One -fifth to Louise Lorentzen <br />One -fifth to Malvina Roeser <br />One -fifth to Emil H.Vieregg j <br />One -fifth to Oscar A.Vieregg, and 1 <br />One -fifth to the children of Albert Vieregg, a deceased son <br />of Henry Vieregg, namely Pauline Vieregg, John Vieregg and <br />Robert Vieregg, <br />so that each of said children were entitled to one - fifth, and so that the grand <br />children were entitled to one -fifth of the proceeds from the sale of said lot 6 above describ�d; <br />and the said Executor, Emil H.Vieregg has reported to the Court that on account of the depres4ed <br />li <br />price of real estate, he did not deem it advisable to sell said real estate, but that he ob- t <br />tained the consent of all the legatees interested therein, and by mutual consent he conveyed <br />said property by executor's deed to the legatees named in the third paragraph of said will, <br />with the exception of Malvina Roeser who departed this life since the death of Henry Vieregg,;; <br />of sai <br />and that the undivided one -fifth interest bequeathed to her under said third paragraph <br />
