WI tr1 IDRIWR� i i WNS IM <br />r� <br />;!,thereof , is attached to and made a part of this proceeding for the .purpose of offering said <br />"instrument for probate in this Court as the last will and testament of said deceased, thereby <br />confirming the appointment of the said John Windolph as executor and authorizing him to admin- <br />ister said estate in said County in accordance with the terms and provisions thereof; that upon' <br />reading and filing said petition an order was entered herein fixing the time and place for <br />hearing the evidence in support of said petition, and gave notice to all interested parties as <br />provided by law; and that said hearing was held, as heretofore ordered by the Court, and said <br />instrument was admitted to probate in this Court as the last will and.testament of said deoeasdd, <br />and John Windolph, named therein as executor, was granted letters testamentary upon filing a <br />bond as provided by law. <br />,That due and legal notice has been given to all persons of the time and place fixed by the <br />Court for filing claims against said estate as provided by law, and that all persons having <br />,claims against said estate, not filed. within the time fixed by the Court, if any such there be <br />are forever barred, excluded and enjoined from setting up or asserting any such claims against`, <br />,,said estate. <br />.,That said deceased departed this life leaving surviving her as her heirs at law, and only heir <br />at law, legatees, devisees, and persons entitled to share in her estate, the following, to -witi <br />John Windolph, surviving husband, John Francis Windolph, Edmund Aloysius Windolph, sons, and <br />a, <br />Lucas Windolph, a nephew. j <br />That said deceased died the owner of an estate situated in Hall County, Nebraska, consisting off <br />both real and personal property, all of which was devised to John Windolph, John Francis Windoip <br />Edmund Aloysius Windolph, and Lucas Windolph in accordance with the terms and provisions of said <br />will, a copy of which is attached hereto and made a part of this decree. Said real estate beint. <br />,described as Lot One (1), Block Seventy -Nine (79) of the original town now City of Grand Islam, <br />;Hall County, Nebraska. <br />That due and legal notice has been given to all persons of the time and place for a hearing <br />on said final report as provided by law, and no one appearing to object to same, the Court fin S <br />that said executor has paid all of the debts, including costs of this proceeding and attorney <br />fees, and said report should be allowed as and for said executor's final report, said estate <br />settled and closed and said executor discharged. <br />;;That said estate is not subject to the payment of any inheritance tax either under the laws of <br />the State of Nebraska or the Laws of the United States of America. <br />i <br />!IT IS THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims <br />;,against said estate not filed and allowed within the time fixed by the Court, if any such them <br />.,be, are forever barred, excluded and enjoined from setting up or asserting any such claims <br />i? <br />against said estate. <br />�i <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report filed herein <br />i <br />a, <br />by John Windalph, executor of said estate, be, and the same is hereby, in all things, approved; <br />and allowed as and for said executor's final report, said estate settled and closed and said <br />executor discharged. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all of the property owned by th <br />said Anna Windolph, deceased, consisting of both real and personal property situated in Hall <br />County, Nebraska, as hereinbefore described in this decree, did pass and descend at her death <br />in accordance with the terms and provisions of her last will and testament, as hereinbefore f <br />by the Court, and distribution thereof is hereby accordingly made. <br />Paul N.Kirk <br />County Judge. <br />, <br />
