<br />of the said Peter Schuchmann,deceased, ever been had in the state of Nebraska; that the petit-
<br />ioner herein is now the owner of an rindivided one -half interest in said premises,and is a com-
<br />petent and proper person to institute and prosecute this proceeding.
<br />The court further finds that the said Peter Schuchmann left surviving him,his widow,Maria C.
<br />Schuchmann,residing in Grand Island, Nebraska,Alma Schuchmann,a daughter, residing in Grand
<br />�Island,Nebraska,Clarence Hugo Schuchmann, a son,residing in Grand Island,Nebraska,all of legal
<br />';age,; that upon the death of the said Peter Schuchmann,under the laws of the state of Nebraska,,
<br />!then in force,the real estate hereinbefore described,passed and descended in equal shares to
<br />the said Alma Schuchmann,Clarence Hugo Schuchmann, as tenants in common,subject only to the
<br />dower and homestead estate of the'said Maria C.Schuchmann.
<br />ii The court further finds that the said Peter Schuchmann,deceased,left a personal estate sufficie
<br />-to pay his funeral expenses and debts, and that such funeral expenses and debts have been fully
<br />,!;paid; that if any debts existed against the estate of the said Peter Schuchmann,deceased, such
<br />debts are long since barred by the Statute of Limitations and are now forever barred and pre -
<br />cluded,and the court further finds that the costs of this proceedings have been paid in full.
<br />The court further finds that at the death of the said Peter Schuchmann,said real estate hereint
<br />described,was of the value of
<br />Dollars and that it is now the the gross
<br />value of about Dollars.
<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED BY THE COURT that the said Peter Schuchmann died
<br />intestate at Grand Island,State of Nebraska; that he died on the 14th day of September,1896,
<br />and that at the time of his death,he was a resident and inhabitant of the city of Grand Island
<br />and state of Nebraska; that more than 33 years have elapsed since the death of the said Peter
<br />Schuchmann; that no administration has ever been had or applied for upon the estate of the said
<br />Peter Schuchmann ;deceased,in the state of Nebraska; that the said Peter Schuchmann died seized
<br />as the owner in fee simple of an estate of inheritance in the Northwest Quarter of the South-
<br />west Quarter and the Southwest Quarter of the Northwest Quarter of Section 24,in Township 11,
<br />North of Range 9,Weet of the Sixth P.M.in Hall County,Nebraska; that he left surviving him,
<br />Maria C,Schuchmann, surviving widow,Alma Schuchmann, a daughter and Clarence Hugo Schuchmann,
<br />a s6n, both of lawful age,as his heirs at law and his only heirs -at -law; that under the laws
<br />'jof descent of the state of 1ebraska in force at the time of the death of the said Peter Schploh-
<br />'mann, the said Maria C.Schuchmann, surviving widow,of the said Peter Schuchmann,deceased,took
<br />a dower and homestead estate in the real estate hereinbefore described and that subject only t
<br />the said dower and homestead estate, the real estate herein described,passed and descended,upo
<br />the death of the said Peter Schuchmann, in the following shares to the said Alma Schuchmann a
<br />Clarence Hugo Schuchmann,and to their respective heirs and assigns forever,and all debts of
<br />said deceased,and all debts against the estate of said deceased,if any such existed,are forev
<br />barred and precluded,and further administration of the estate of the said Peter Schuchmann,
<br />deceased,is hereby dispensed with,and said estate is forever settled and closed.
