<br />ow on this 6th day of July, 1932, this cause came on for hearing on the final report of the
<br />executors heretofore filed, and it appearing to the satisfaction of the Court that notice by
<br />blication was given to all persons interested in said estate, of the filing of said report-an
<br />the time fixed and place appointed for hearing the same, and there being no objections thereto,
<br />d no one appearing in person to object, the Court examined said report and finds the same to
<br />e correct and that it should be approved and allowed.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED, that the final report of the executors be and th
<br />same is hereby approved and allowed as and for their final accounting.
<br />THE COURT FURTHER FINDS that notice by publication as by law and the order of this court requirid,
<br />has been given to all creditors and other persons interested, of the time fixed and place appoi�ted
<br />for filing claims against said estate, and that said time has fully elapsed and expired, and th�t
<br />all claims filed against said estate are paid and fully satisfied, and that any claims not so
<br />filed, if any such therebe, should be forever barred and precluded.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED, That all claims filed against said estate have
<br />been fully paid and satisfied, and that any claims not so filed, if any such therebe, should be
<br />and the same are hereby forever barred and precluded.
<br />THE COURT FURTHER FINDS, That Reimer Hargens departed this life on the 29th day of June, 1931,-
<br />while a resident and inhabitant of Hall County, Nebraska, leaving a last will and testament,
<br />ich has been heretofore admitted to probate in this court; that at the time of his death the
<br />said Reimer Hargens left surviving him as his heirs at law and only heirs at law, Louise Hargen�,
<br />whose true name is Elise Hargens, his widow, and Margaretha Bahrs, a daughter residing in Germa�y,
<br />and Emma Wagner, a daughter, residing in Grand Island, Nebraska.
<br />THE COURT FURTHER FINDS, that at the time of his death, the said Reimer Hargens was the owner i.
<br />fee of Lot Seven
<br />(7) in Block Seven (7) of Windolphs Addition to Grand Island,Hall County, Ne-
<br />braska, and was the owner of personal propery as listed in the inventory; that according to the
<br />provisions of said last will and testament, the real estate above described was devised to Elis
<br />nargensI his widow in fee simple, and the personal property was bequeathed to her to have the
<br />use and income therefrom for and during her natural life; that upon the death of said Elise

<br />g �5 paid to Margaretha Bahrs, providing she is then living, but in the
<br />event she precedes her mother in death, then said sum of $5000.00 upon the death of Elise Harge s,
<br />is to be paid to Anna Wagner, now Anna. Wagner Holtdorf „ and Elma Wagner, now Irma Wagner Schrooder.,
<br />share and share alike, but should one of said last named persons have preceded Elise Hargens in
<br />death, then the entire sum to be paid to the survivor; and that all of the rest, residue and
<br />remainder of said estate was bequeathed to Emma Wagner, a daughter.
<br />THE COURT FURTHER FINDS that by agreement between the parties interested, the sum of $5500.00 i
<br />mortgages has been set aside to be held by Otto Wagner and Arthur C.Mayer, as trustees for the
<br />purpose of carrying out the bequest to Margaretha Bahrs.
<br />THE COURT FURTHER FINDS, that there is no inheritance tax due from any of the above named heirs
<br />nor is there any federal estate tax due.
<br />IT IS THEREFORE CONSIDERED, ADJUDGED AND DECREED, that according to the provisions of the last
<br />will and testament of Reimer Hargens, deceased, Lot Seven (7) in Block Seven (7) of Windolphs
<br />Addition to the City of Grand Island,Hall County, Nebraska, did pass and descend to Elise Harge s
<br />his widow, in fee simple; that all of the remaining property passed to her for her use and bene
<br />fit during her natural lifetime, and
