DECREE
<br />In the Matter of the Estate

<br />Henry C.Hamilton, Deceased.
<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.
<br />D E C R E E
<br />Now on this 31st day of May, 1932, this cause came on for hearing before the Court upon the
<br />petition of Nancy Hamilton and evidence duly introduced. The Court being fully advised in them
<br />premises finds from the evidence and from the proofs on file that due and legal notice has beef
<br />given to all persons interested in the said estate, including creditors and heirs, by publica
<br />tion as provided by law and as required by the order of this Court, and that no objections to
<br />the granting of the said petition have been filed.

<br />The Court further finds that the said Henry C.Hamilton died intestate at Grand Island,Nebraska,
<br />on March 8, 1924,.more than two years prior to the filing of the petition herein, at the.time
<br />of his death being a resident and inhabitant of Hall County, Nebraskat and being the owner at
<br />the time of his death of the fee simple title to Lot 5, in Block 7, College Addition to West
<br />Lawn, Grand Island, Hall County, Nebraska. The Court further finds that no application has
<br />heretofore been made in the state of Nebraska for the appointment of an Administrator of the
<br />estate of the said Henry C.Hamilton either by his heirs or by any person claiming to tte-a
<br />creditor of or otherwise.interested in the said estate, and finds that all indebtedness of the"
<br />said estate has been paid in full and has been wholly barred by lapse of time.
<br />The Court.further finds that the said Henry C.Hamilton left surviving him the following heirs'
<br />at law : -
<br />Nancy Hamilton, hisvd dow, of Grand Island, Nebraska, who is the petitioner herein and who is
<br />the owner of an undivided interest in and to the said real estate as such heir at law;
<br />Franklin E.Hamilton, a son, of Chanute, Kansas;
<br />Jesse Lee Hamilton, a son, of Grand Island,Nebraska;
<br />Lizzie Fuller, a daughter, of Denver, Colorado;
<br />and that the real estate should be assigned and set over to the said heirs at law in the pro-
<br />portions provided by law.
<br />IT IS, THEREFORE, ORDERED AND DECREED that the facts hereinbefore stated are judicially est
<br />lished as true. That the said Henry C.Hamilton died intestate as aforesaid more than two ye
<br />prior to the filing of the petition herein, then being a resident of Hall County, Nebraska, a
<br />the owner of the real estate hereinbefore described and having left the said heirs at law, an
<br />that no application has, heretofore been made for the appointment of an Administrator of said
<br />estate.
<br />IT IS FURTHER ORDERED AND DECREED that the real estate, to -wit: Lot 5, Block 7, College Addi -ii
<br />tion to West Lawn, Grand Island, Hall County, Nebraska, be, and the same is hereby, assigned
<br />and distributed to the said heirs at law in the following undivided shares:- To Nancy Hamilton
<br />one- third, to Franklin E.Hamilton, two - ninths, to Jesse Lee Hamilton two ninths, and to Lizzi
<br />Fuller two - ninths.
