<br />I, Hans Wiese, of Hall County, Nebraska, being of sound mind and disposing memory, do make
<br />and publish this, my last will'and testament.
<br />FIRST.
<br />I direct that all of my just debts be first paid out of my personal property.
<br />SECOND.
<br />I give and bequeath to my beloved wife, Catherine E.Wiese, all of my household and kitchen fur�:-
<br />niture. Also, all of my personal ornaments, jewelry,wearing apparel, and heirlooms of every
<br />kind, and request that she make such distribution of the latter named articles among my childr'en
<br />or grandchildren as she may deem advisable.
<br />THIRD.'
<br />I give, devise, and bequeath to my son, William J.Wiese, for and during his natural lifetime,
<br />the Northeast Quarter of the Southwest Quarter, and the East Half of the Northwest Quarter of
<br />Section Thirty -four; also, a tract or parcel of land situated in Northwest Quarter of the North-
<br />west Quarter of said. Section 34, described as follows: Commencing at the northeast corner of
<br />the Northwest Quarter of the Northwest Quarter of said Section Thirty- four,running thence South
<br />fifty -two rods; thence West Thirty rods; thence North fifty -two (52) rods to the north boundary
<br />line of said Section 34; thence East along the said north boundary line of said Section thirty;
<br />rods, to the place of beginning, and containing ten acres of land, a little more or less; alsoj,
<br />Lot Number Four on Island., and the South Half of the Southwest Quarter of Section Twenty - seven;,
<br />all in Township Ten North of Range Eleven West, in Hall County, Nebraska. And I direct that
<br />during the term of said life estate given to my said son, William J.Wiese, in the above described
<br />lands, he shall not have the power of sale, assignment, alienation, or incumbrance of same i n
<br />any way, nor shall any debts or obligations contracted by him be liens on said life estate, ov,
<br />upon the fee thereof, nor subject said estate herein given to him to sale or disposition by
<br />execution or other porcess. After the death of my said son, William J.Wiese, should he leave
<br />a widow, issue or descendants him surviving, then the remainder in fee of said lands shall pa
<br />and descend to such widow, issue or descendants as provided by the law of descent of Nebraska,;
<br />in force at the time of his death. In case of his death leaving a widow him surviving, but not
<br />issue or descendants, then the remainder in fee shall pass to said widow absolutely. In case
<br />said William J.Wiese should leave no widow, and no issue or descendants him surviving, then t
<br />remainder over in said land shall pass and descend and is hereby devised, in equal shares, to
<br />my children, August P.Wiese, Emma C.Strasser and Matilda M.Strasser, and in case of the death
<br />of any of said remaindermen leaving issue or descendants surviving, then such issue or des-
<br />cendants shall take the parent's share by right of representation. Provided, however, that
<br />said wife, Catherine E.Wiese, shall have a home and place of abode in the house now located
<br />on said p remises, (or in any other house built for a home thereon), during her lifetime, if
<br />i;
<br />she elects to live thereon. In no event shall this clause of my will be construed as giving
<br />f
<br />to my son, William J.Wiese, a greater estate in said lands than for his lifetime. The premiss
<br />described in this clause of my will includes my homestead, which I desire shall remain in the,,
<br />Wiese family as long as possible, and for that reason have made the foregoing devise thereof
<br />FOURTH.
<br />All of the rest, residue and remainder of my estate, real, personal, and mixed, and wherever
<br />situate, I give, devise and bequeath unto my beloved wife, Catherine E.Wiese, for her sole
<br />use and benefit during her natural lifetime. And I direct that my said wife shall have full
