<br />Now, on this 26 day of January, 1932, this cause came on for hearing upon the final report of
<br />Elizabeth B.Meyer, Executrix of the last will and testament of August Meyer, deceased, and upo
<br />her petition for settlement of said estate, and her discharge herein, and the Court, having
<br />ermined said report and the records and files in said estate, and being duly advised in the pre
<br />I
<br />�Iises, finds that due and legal notice has been given to all persons interested in said estate
<br />Hof the time and place fixed for hearing upon said final report as ordered by the Court, and no
<br />lone appearing to object thereto, the Court examined the same, together with all the records and
<br />files, and the testimony, and being duly advised, finds that said report is true and correct ar.
<br />!ought to be approved and allowed as and for the finalieport of said Executrix.
<br />=The Court further finds that said August Meyer departed this life in Grand Island,Nebraska, on
<br />;the 4th day of September, 1930, and at the time of his death was a resident and inhabitant of
<br />Hall County, Nebraska.
<br />;The Court further finds that on the llth day of September, 1930, a petition was filed for the
<br />,probate of a document purporting to be the last will and testament of said deceased, due and
<br />legal notice of hearing thereon was given by the Court and the time of the hearing fixed as of
<br />,October 7, 1930, and on said date said last will and testament was duly admitted to probate
<br />and letters testamentary issued thereon to Elizabeth B.Meyer, Executrix, and she thereupon
<br />qualified as such.
<br />The Court further finds that due and legal notice has been given to all persons having claims
<br />against said estate, to file said claims on or before the 4th day of February, 1931, and that
<br />no claims were filed.
<br />The Court further finds that laid August Meyer died seized of personal property and real prop
<br />and that the same passed and descended under said last will and testament as follows:
<br />A one -half partnership interest in the copartnership known as August Meyer & Sons has been
<br />delivered to Robert A.Meyer and Ernest J.Meyer, as Trustees, upon the condition that the incom
<br />therefrom, or in the event of said interest being sold, the income from said proceeds, to be
<br />paid to Elizabeth Meyer, for and during her natural life and thereafter said property to becom
<br />the property of Robert A.Meyer and Ernest J.Meyer, share and share alike:
<br />Lot Six (6) in Block One Hundred Two (102) in Koenig & Wiebe's Addition-to the city of Grand
<br />Island, Nebraska, and the center one - third of the northerly eighty -eight (98) feet of Lot Four'
<br />(4) in Block Sixty -six (66) of the Original Town, now Cityy, of Grand Island.,Hall County, Ne-
<br />braska, passed and descended to Ernest J.Meyer, Robert A.Meyer, and August H.Meyer, subject
<br />to the life interest therein, in Elizabeth B.Meyer, and upon the further condition that the
<br />interest of August H.Meyer, shall be free and clear of all incumbrances, and
<br />The easterly one -third of the northerly eighty -eight (99) feet of Lot Four (4) in Block Sixty -
<br />six (66) in the Original Town, now City, of Grand Island,Hall County, Nebraska, passed and
<br />descended to Ernest J.Meyer and Robert A.Meyer, share and share alike, subject to the life
<br />interest therein in Elizabeth B.Meyer.
<br />The Court further finds that said estate was not subject to inheritance tax.
<br />IT IS, THEREFORE; ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Elizabet
<br />B.Meyer, Executrix under said last will and testament of August Meyer, deceased, be, and the
<br />same is hereby approved and allowed as and for her final report, said estate is hereby settled
<br />and closed and said Executrix discharged and her bond as such is hereby released.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the time fixed for filing claims
<br />having expired that all claims against said estate, not filed herein, are forever barred and
<br />excluded.
<br />IT IS FURTHI'R ORDERED, ADJUDGED AND DECREED that �jnder and by virtue of the said last will and
<br />testament of said August Meyer, deceased, the absolute title to the following described real
<br />estate-passed and descended as follows:
<br />Lot 6 in Block 102 in Koenig & Wiebe's Addition to the city of Grand Island,Hall County,
<br />Nebraska, and the center one -third of the northerly 89 feet of Lot 4 in Block 66 of the
<br />Original Town, now City, of Grand Island,Hall County, Nebraska) to Ernest J.Meyer, Robert
<br />A.Meyer, and August H.Meyer, subject to the life interest therein in Elizabeth B.Meyer, and
<br />upon the further condition that the interest of August H.Meyer shall be free and clear of all
<br />incumbrances, and
