<br />Now, on-this 12 day of November 1931, this cause came on for a hearing upon the final report o�
<br />11C.H.Kolling and James F.Durbin, administrators with Will annexed of the estate of John Kearneyy

<br />deceased, and upon their petition for settlement of said estate and their discharge herein, anc
<br />1the court having examined said report and the records and files in said estate, and being duly;,
<br />it in the premises, finds that.due and legal notice has been given to all persons interested
<br />i
<br />,!in said estate of the time and place fixed for a hearing upon the said final report as hereto -'
<br />i�fore ordered by the court, and no one appearing to object thereto, and the court having examined
<br />;the same, together with all vouchers and papers on file, and the testimony in support thereof,,
<br />;'and being fully advised in the premises, finds that the said report is true and correct in all"
<br />things and ought to be allowed as and for the final report of the said administrators with the

<br />The court further finds that the said John Kearney, deceased, departed this life at his place
<br />of residence in York County, Nebraska, on the 11th day of September, 1929, and at the time of
<br />J
<br />his death he was a resident and inhabitant of York County, Nebraska.
<br />The court further finds that on the 301' day of September, 1929, Frank Kearney, filed in this
<br />court, his duly verified petition praying for the allowance and probate of an instrument pur-
<br />ported to be the last will and testament of the said John Kearney,deceased, and that the court
<br />thereupon fixed the 21" day of October, 1929) as the date for making a proof of said last will
<br />and testament, and due notice of the filing of said petition and of the time and place fixed
<br />for the hearing thereon, were given by the court in the manner and form provided by law, and
<br />that on the 13th day of November, 1929, said instrument was duly proven, allowed and admitted
<br />to probate in this court, as and for the last will and testament of the said John Kearney, de -f!
<br />ceased, and thereupon, letters testamentary were duly issued to C.H.Kolling and James F.Durbip
<br />i
<br />and they thereupon duly qualified as such.
<br />The court further finds that due and legal notice has been given to all persons of the time aiiHd
<br />place fixed for filing claims against said estate, and that all claims filed have been paid aid
<br />satisfied, and that the time fixed for filing all claims, has fully expired, and that all per
<br />sons having claims against said estate, if any such there be, are forever barred and precluded
<br />from setting up or asserting any such claims against said estate.
<br />The court further finds that the said John Kearney, deceased, was seized as the owner in fee e
<br />simple title, of the following described real estate, to -wit:
<br />The Northeast Quarter (N*) of Section Five (5), Township Eleven North (11N),
<br />Range Eleven (11) West of the 6th P.M., Hall County, Nebraska; and
<br />the North Half (N2 ) of the South Half ( ) of the Northwest Quarter (1*) of the
<br />Southwest Quarter (SWJ) of Section Five (5), Township Ten N o (10N) Range Two (2)
<br />West of the 6th P.M., in York County, Nebraska.
<br />The court further finds that under the terms of the said last will and testament of the said
<br />John Kearney, deceased, he bequeathed to Mary Frances Kearney the sum of Twelve Hundred Dol-
