fixed the 14th day of April, 1931, as the date for making proof of said last will and testamen <br />and due and legal notice of the filing of said petition and of the time and place fixed for <br />hearing thereon was given by the Court as by law provided, and on said date of April 14, 1931,= <br />said instrument was duly approved, allowed, and admitted to probate in this Court as and for t e <br />I <br />last will and testament of John F.UVeinrich,deceased, and letters testamentary were thereupon <br />duly issued to Della B.Weinrich, Executrix as named in said last will and testament, and she E1 <br />A <br />thereupon furnished bond and qualified as such. <br />The Court further finds that due and legal notice has been given to all persons of the time anc <br />place fixed by the Court for the filing of claims against said estate, that the claim of the <br />!!Nebraska National Bank, to which objections were filed has been satisfied in full, and that all <br />claims filed, including funeral expenses and costs of administering said estate, have been pa.i4 <br />;i <br />jand that the time fixed for filing claims has fully expired, and all persons having claims <br />'against said estate, if any such there be, and not filed herein, are forever barred and excludod <br />;from setting up or asserting any such claims against said estate. <br />.The Court further finds that the said John F.Weinrich died seized of the following described <br />real estate, to -wit: The east half of the southwest quarter of Section Thirty -dne (31), in <br />lTownship Eleven (11) North of Range Ten (10) West of the 6th P.M., in Hall County, Nebraska, <br />;land said real estate passed and descended, and was devised, under said last will and testamenth <br />to Della B.Weinrich, to have the same absolutely. <br />The Court further finds that said John F.Weinrich; died seized of the following described real <br />estate, to -wit: <br />The west half of the northwest quarter of Section Six (6), Township Ten (10) North <br />Range Ten (10) West of the 6th P.M., containing 76 acres, more or less, in Hall <br />County, Nebraska, <br />and that said real estate and all of the rest,residue, and remainder of the personal property, <br />passed and descended and was devised under said last will and testament, to George E.Weinrich <br />and Loren F.Weinrich, and Mary E.Rouse, share and share alike, subject to the provision that <br />the share of Mary E.Rouse shall be held in trust for her use and benefit until she shall attaii <br />the age of thirty -five years. <br />The Court further finds that under said last will and testament the said Della B.Weinrich was <br />named and appointed as such trustee for the benefit of said Mary E.Rouse, to have charge of <br />the property bequeathed and devised to said Mary E.Rouse under the terms and conditions of saic <br />last will and testament. <br />The Court further finds that said estate was not subject to inheritance tax. <br />The Court further finds that all personal property has been delivered and distributed as by th, <br />last will and testament of said John F.Weinrieh; provided. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT, that the final report of Della <br />B.Weinrich, Executrix of the last will and testament of John F.Weinrich, deceased, be, and the <br />same is hereby approved and allowed as and for her final report, and said estate is hereby <br />settled and closed and said Executrix discharged and her bond as such is hereby released. <br />IT IS FURTH7R ORDERED, ADJUDGED AND DECREED BY THE COURT that the time for filing claims has <br />expired, and that all claims not filed against said estate are hereby barred. <br />IT IS FURTH R ORDERED, ADJUDGED AND DECREED BY THE COURT that under and. by virtue of the last <br />will and testament of said John F.Weinrich,deceased, the absolute title to the following des - j <br />'i <br />cribed real estate, the east half of the southwest quarter of Section 31, in Township 11 Northli <br />of Range 10 West of the 6th P.M., in Hall County, Nebraska, passed and descended to Della B. <br />Weinrich, sole devisee under paragraph third of said last will and testament. <br />i <br />
