<br />INOW, on this 29th day of September, 1931, this cause came on for hearing upon the petition of
<br />Eva L.Murphy,widow and sole beneficiary under the Last Will and Testament of Philip I.Murphy,
<br />deceased, late of Shawnee County, in the State of Kansas, and owner of the following described
<br />real estate, to -wit: " An undivided one -half interest in Lots 21, 23, 25, 27, 29 and 31, in
<br />Foster's Sub - division of Lots 11 and 12, of Wood Lawn Subdivision of part of the Northeast
<br />Quarter (NE-1) and part of the Southeast Quarter (SE4), of Section Twenty -four (24), Township
<br />Eleven (11),Range Twelve (12), and Lot 5, and three feet and two and three - fourths inches of
<br />the West side of Lot 4, Block 25, in the Town of Wood River, Hall County, Nebraska, including
<br />the vacated part of the northerly fifteen feet of North Street, lying due south of said Lot 5,
<br />and said part of Lot 4, all as surveyed, platted and recorded;" praying for an order of the
<br />Court fixing the time and place of the death of said Philip I.Murphy,deceased, and for the
<br />allowance and probate of the Last Will and Testament of said deceased as a Foreign Will, for a
<br />determination of who were the heirs -at -law of said deceased, and to whom the real estate here -
<br />inbefore described, owned by said deceased at the time of his death, passed and descended, and
<br />for a settlement of the estate of said deceased, and the Court, having examined the records an
<br />files herein, and listened to the testimony in support of said petition, and being fully advis
<br />in the premises, finds that due and legal notice has been given to all persons, including heir
<br />at -law, legatees, devisees, and creditors, of said deceased, of the time and place fixed for a
<br />hearing upon said petition, by publication in the Grand Island Independent, a legal newspaper
<br />published in and of general circulation in Hall County, Nebraska, as heretofore ordered by the
<br />Court.
<br />The Court further finds that the s;
<br />day of April, 1929; a resident and
<br />that he left surviving him, as his
<br />petitioner herein, surviving widow
<br />a daughter, Ralph E.Murphy, a son,
<br />iid Philip I.Murphy departed this life, testate, on the 25th
<br />inhabitant of Shawnee County, in the State of Kansas`, and
<br />heirs -at -law, and his only heirs -at -law, Eva L.Mufphy, the
<br />of said Philip I.Murphy, deceased; Myrtle E.Murphy Simpson,
<br />Loretta Murphy Hogin, a daughter, and Bessie,commonly calle
<br />(Bess Murphy Elden, a daughter, all of whom are of legal age.
<br />The Court further finds that by consideration of the Probate Court in and for the County of
<br />I
<br />Shawnee and State of Kansas, and being the Court having original jurisdiction of the allowance
<br />sand probate of the last will and testament of said Philip I-.Murphy,deceased, the last will and
<br />i
<br />testament of the said Philip I.Murphy,deceased, was duly proven, allowed, and admitted to pro-
<br />;bate, on the 27th day of April, 1929, and that a duly authenticated copy of said last will and
<br />I
<br />!testament of the said Philip I.Murphy, deceased, together with the probate thereof, by the
<br />Probate Court of the County of Shawnee, and State of Kansas, has been duly filed in this Court
<br />and cause, as and for the last will and testament of the said Philip I.Murphy, deceased, and
<br />that said Last Will and Testament of the said Philip I.Murphy,deceased, is entitled to and oug
<br />to be allow6d and admitted to probate by this Court as and for the Last Will and Testament of
<br />the said Philip I.Murphy, deceased, the said Philip I.Murphy having died as the owner,by fee
<br />simple title absolute, of the following described real estate situated in the County of Hall
<br />and State of Nebraska, to -wit: "An undivided one -half interest in Lots 21, 23, 25, 27, 29 and
<br />31, in Foster's Subdivision of Lots 11 and 12, of Wood Lawn Subdivision of part of the Northea
<br />Quarter (NEJ) and part of the Southeast Quarter (SEJ), of Section Twenty -four (24), Township
<br />Eleven (11), Range Twelve (12), and Lot 5, and three feet and two and three - fourths inches of
<br />Ilthe West side of Lot 4, Block 25, in the Town of Wood River, including the vacated part of the
<br />1 northerly fifteen feet of North Street, lying due south of said Lot 5, and said part of Lot 4,
<br />!all as surveyed, platted and recorded;" upon which said last will and testament operates.
