<br />ceased and her family, who are named hereinabove, as their homstead, and that said John D.Stac�"'
<br />widower-of said deceased herein, is entitled to a homestead right thereon, which has not been
<br />iset off to him out of said lands by special proceedings in this court; that said real estate
<br />passed and descended under and by virtue of the laws of descent and distribution of the State
<br />of Nebraska in the following proportion, subject to the homestead rights of the said John D.
<br />Stack, to -wit:
<br />John D.Stack, an undivided one -third (1/3) interest in said premises; and that
<br />an undivided two - thirds (2/3) interest in said premises passed and descended,
<br />share and share alike, to James Thomas Stack, John Leo Stack and Francis Clement
<br />Stack.
<br />The Court further finds that there was no personal property in said estate; that said estate
<br />was not subject to inheritance tax under the laws of the State of Nebraska.
<br />The court further finds that all the debts and claims against the said estate and the costs
<br />of this proceeding have been paid.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT, that the final report of Edward
<br />F.Hannon, administrator of the estate of Margaret Agnes Stack, deceased, be, and the same is
<br />hereby approved and allowed as and for his final ireport, and that said estate is hereby settlec
<br />and closed, and said administrator discharged and his bond as such is hereby released.
<br />IT IS FURTHkR ORDERED, ADJUDGED AND DECREED BY THE COURT that under and by virtue of the laws
<br />of descent and distribution of the State of Nebraska, the absolute title to the following des-
<br />cribed real estate, to -wit:

<br />The Southwest Quarter (SWJ) of the Northwest Quarter (NWJ), and an undivided two- thirds in-
<br />terest in the North Half (N21) of the Northwest Quarter (NWJ), and an undivided two - thirds in-
<br />terest in the Southeast Quarter (SE4) of the northwest quarter (NW�) of Section Seven (7),
<br />Township Ten North (10N),Range Twelve (12) West of the 6th P.M.,Hall County,Nebraska, i
<br />passed and descended, subject to the homestead rights of John D.Stack, in the following manner.
<br />An undivided one -third (1/3) interest to John D.Stack; and an undivided two - thirds (2/3) in-
<br />terest to James Thomas Stack, John Leo Stack, and Francis Clement Stack, share and share alikel
